HISMAJESTY THEKINGOFTHEBELGIANS, HERMAJESTY THEQUEENOFDENMARK, THEPRESIDENTOFTHEFEDERALREPUBLICOFGERMANY, THEPRESIDENTOFTHEHELLENICREPUBLIC, THEPRESIDENTOFTHEFRENCHREPUBLIC, THEPRESIDENTOFIRELAND, THEPRESIDENTOFTHEITALIANREPUBLIC, HIS ROYALHIGHNESSTHEGRANDDUKE OFLUXEMBOURG, HERMAJESTY THEQUEENOFTHENETHERLANDS, HER MAJESTY THE QUEEN OF THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERNIRELAND, HavingregardtoArticle96oftheTreatyestablishingtheEuropeanCoalandSteelCommunity, HavingregardtoArticle236oftheTreatyestablishingtheEuropeanEconomicCommunity, HavingregardtoArticle204oftheTreatyestablishingtheEuropeanAtomicEnergyCommunity, Whereas theGovernmentoftheKingdom ofDenmarkhassubmittedaproposaltotheCouncilforthe purposeofrevisingtheTreatiesestablishingtheEuropeanCommunitiessothattheyceasetoapplyto Greenland andintroducingnewarrangementsgoverningrelationsbetweentheCommunities and Greenland; Whereas,inviewofthespecialfeaturesofGreenland,thisproposalshouldbeacceptedbyarrangements beingintroducedwhich permitcloseandlastinglinksbetweentheCommunityandGreenland tobe maintained andmutual interests,notablythedevelopmentneedsofGreenland,tobetakeninto account; Whereas thearrangementsapplicabletooverseascountriesandterritoriessetoutinPartFourofthe TreatyestablishingtheEuropeanEconomicCommunityprovideanappropriateframeworkforthese relations,althoughadditionalspecificprovisionsareneededtocaterforGreenland, HAVEDECIDEDtodeterminebycommonagreementnewarrangementsapplicabletoGreenlandand have,tothisend,designatedastheirPlenipotentiaries:

Article 1 The followingsubparagraphshallbeaddedtopoint(a) ofthesecondparagraphof Article79oftheTreatyestablishingtheEuropeanCoalandSteelCommunity: 'ThisTreatyshallnotapplytoGreenland.'

Article 2 Denmark shallbeaddedtotheMember Statesspecifiedinthefirstsentenceofthefirst paragraphofArticle 131oftheTreatyestablishingtheEuropeanEconomicCommunity.

Article 3 1. ThefollowingArticle 136ashallbeaddedtoPartFouroftheTreatyestablishingthe EuropeanEconomicCommunity: 'Article 136a TheprovisionsofArticles 131to136shallapplytoGreenland,subjecttothespecific provisionsforGreenlandsetoutintheProtocolonspecialarrangementsforGreenland, annexedtothisTreaty.' 2. TheProtocolonspecialarrangementsforGreenland attachedtothisTreatyshallbe annexedtotheTreatyestablishingtheEuropeanEconomicCommunity. Protocol4on Greenland,annexedtotheActofAccessionof22January1972,isherebyrepealed.

Article 4 Greenland shallbeaddedtothelistinAnnex IVtotheTreatyestablishingtheEuropean EconomicCommunity.

Article5 Thefollowingsubparagraphshallbeaddedtopoint(a)ofthethirdparagraphofArticle198 oftheTreatyestablishingtheEuropeanAtomicEnergyCommunity: 'ThisTreatyshallnotapplytoGreenland.'

Article 6 1. ThisTreatyshallberatifiedbytheHigh ContractingPartiesinaccordancewith their respectiveconstitutionalrequirements.Theinstrumentsofratificationshalbedepositedwith theGovernmentoftheItalianRepublic. 2. ThisTreatyshallenterintoforceon1January1985.Ifalltheinstrumentsofratification havenotbeendepositedbythatdate,thisTreatyshallenterintoforceonthefirstdayofthe month followingthedepositoftheinstrumentofratificationbythelastSignatoryStateto takethisstep.

Article 7 ThisTreaty,drawnupinasingleoriginalintheDanish,Dutch,English,French,German, Greek,Irish,andItalianlanguages,alleighttextsbeingequallyauthentic,shallbedeposited inthearchivesoftheGovernmentoftheItalianRepublic,which shalltransmitacertified copytoeachoftheGovernmentsoftheotherSignatoryStates.

PROTOCOL onspecialarrangementsforGreenland

Article 1 1. The treatmentonimportintotheCommunity ofproductssubjecttothecommon organizationofthemarket infisheryproducts,originatinginGreenland,shall,while complyingwith themechanisms ofthecommonmarket organization,involveexemption fromcustomsdutiesandchargeshavingequivalenteffectandtheabsenceofquantitative restrictionsormeasures havingequivalenteffectifthepossibilitiesforaccesstoGreenland fishingzonesgrantedtotheCommunitypursuanttoanagreementbetweentheCommunity andtheauthorityresponsibleforGreenlandaresatisfactorytotheCommunity. 2. All measures relatingtotheimportarrangementsforsuchproducts,includingthose relatingtotheadoptionofsuchmeasures,shallbeadoptedinaccordancewiththeprocedure laiddowninArticle43oftheTreatyestablishingtheEuropeanEconomicCommunity.

Article 2 The Commission shallmake proposalstotheCouncil,which shallactbyaqualified majority,forthetransitionalmeasureswhichitconsidersnecessary,byreasonoftheentry intoforceofthenewarrangements,with regardtothemaintenance ofrightsacquiredby naturalorlegalpersonsduringtheperiodwhenGreenlandwaspartoftheCommunityand theregularizationofthesituationwith regardtofinancialassistancegranted by the CommunitytoGreenlandduringthatperiod.

Article3 ThefollowingtextshallbeaddedtoAnnexItotheCouncilDecisionof16December1980 ontheassociationoftheoverseascountriesandterritorieswith theEuropeanEconomic Community: '6. DistinctcommunityoftheKingdomofDenmark: — Greenland.'
