med beaktande av fördraget om Europeiska unionens funktionssätt,
med beaktande av Europaparlamentets och rådets förordning (EU) 2018/848 av den 30 maj 2018 om ekologisk produktion och märkning av ekologiska produkter och om upphävande av rådets förordning (EG) nr 834/2007, särskilt artikel 46.1, och
1 Bilaga II till kommissionens genomförandeförordning (EU) 2021/1378 antogs för att innehålla en förteckning över kontrollmyndigheter och kontrollorgan som i enlighet med artikel 46.1 i förordning (EU) 2018/848 erkänts som behöriga att utföra kontroller och utfärda ekologiska certifikat i tredjeländer för import av ekologiska produkter till unionen i enlighet med artikel 45.1 b i i den förordningen.
2 I artikel 46.2 i förordning (EU) 2018/848 fastställs de kriterier som kontrollmyndigheterna och kontrollorganen måste uppfylla för att erkännas i enlighet med artikel 46.1 i den förordningen. I kommissionens delegerade förordning (EU) 2021/1698 fastställs de förfarandekrav som dessa kontrollmyndigheter och kontrollorgan ska uppfylla när de lämnar in sin begäran om erkännande i form av teknisk dokumentation till kommissionen.
3 Sedan genomförandeförordning (EU) 2021/1378 antogs har kommissionen tagit emot begäranden om erkännande, som lämnats in i enlighet med artikel 46.4 i förordning (EU) 2018/848, från flera kontrollorgan.
4 Kommissionen har i enlighet med artikel 1 i delegerad förordning (EU) 2021/1698 tagit emot och granskat begäranden om erkännande från bio.inspecta AG, Caucascert LLC, CCPB Srl, CERES Certification of Environmental Standards GmbH, CERTIMEX, Certificadora Mexicana de Productos y Procesos Ecologicos S.C., Control Union Certifications B.V., Ecocert SAS, ECOGLOBE LLC, FOOD SAFETY SA, IMO Control Private Limited, Kiwa BCS Öko-Garantie GmbH, Mayacert SA, Organic Control System LLC Subotica, Organic Standard LLC, Servicio de Certificación CAAE S.L.U., Southern Cross Certified Australia Pty Ltd och Tse-Xin Organic Certification Corporation. På grundval av informationen i den tekniska dokumentationen har kommissionen dragit slutsatsen att det är motiverat att på obestämd tid erkänna dessa kontrollorgan för vissa produktkategorier i vissa tredjeländer.
5 Genomförandeförordning (EU) 2021/1378 bör därför ändras i enlighet med detta.
6 De åtgärder som föreskrivs i denna förordning är förenliga med yttrandet från kommittén för ekologisk produktion.
HÄRIGENOM FÖRESKRIVS FÖLJANDE.
Artikel 1
Bilaga II till genomförandeförordning (EU) 2021/1378 ska ändras i enlighet med bilagan till den här förordningen.
Artikel 2
Denna förordning träder i kraft den tredje dagen efter det att den har offentliggjorts i Europeiska unionens officiella tidning.
