Opinion of Mr advocate-general Reischl
Mr President,
Members of the Court,
I —. The reference for a preliminary ruling with which my opinion today is concerned relates to three independent criminal proceedings pending before the Amtsgericht Reutlingen and concerned with the interpretation of the German Auslandergesetz (Aliens Law) of 28 April 1965 and in particular with the application of the penal provisions of Article 47 of that law to nationals of the Member States of the Community. The facts of the three cases are as follows:
II —. There are already decisions of the Court on a number of the problems raised in these questions. Accordingly it appears to me useful to draw together the basic points of this case-law before I give my opinion on the questions referred to the Court for a preliminary ruling.
III —. I therefore propose that the questions referred to the Court for a preliminary ruling should be answered as follows:
