Opinion of the Advocate General

Mr Advocate General Jacobs delivered his Opinion on 17 May 1990. He proposed that the Court should declare that, by omitting to comply with Articles 3(2) and 12 of Directive 75/442/EEC, Article 10 of Directive 76/403/EEC and Articles 12(2) and 16 of Directive 78/319/EEC, the Italian Republic had failed to fulfil its obligations under the EEC Treaty, and order the Italian Republic to pay the costs.
