The European Court of Human Rights (Fourth Section), sitting on 23 November 2017 as a Committee composed of:

and Liv Tigerstedt, Acting Deputy Section Registrar,

Having regard to the above application lodged on 8 February 2016,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Ion Țurcanu, was born in 1953.

The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”).

On 5 January 2017 the Government informed the Registry that the applicant had died.

On 22 September 2017, the Registry sent a letter to the applicant’s address asking whether there was a person who wished to pursue the proceedings of the case.

On 17 October 2017 the above mentioned letter returned to the Court with the mention: “recipient deceased; inhabited address”.

There is no previous letter from the applicant informing the Court about any change of address.

THE LAW

In the light of the foregoing, the Court concludes that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
