Having regard to the above application lodged on 31 August 2020,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Toader Neagu, was born in 1937. He was represented by Ms G. Balan, a lawyer practising in Bucharest. The applicant’s complaints under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 concerning the non-enforcement or delayed enforcement of domestic decisions were communicated to the Romanian Government (“the Government”).

On 10 November 2023 Ms G. Balan informed the Court that she was no longer representing the applicant.

On 7 February 2024 the Government informed the Registry that the applicant had died on 2 January 2021.

A week later the Registry sent a letter, by registered post, to the applicant’s home address, asking whether there was any potential heir wishing to pursue the proceedings before the Court. On 18 March 2024 the letter returned to the Court as “unclaimed”.

THE LAW

In the light of the foregoing, the Court concludes that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
