Having regard to the above application lodged on 2 March 2017,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant’s details are set out in the appended table.

The applicant was represented by Mr A.S. Kolozsi, a lawyer practising in Oradea.

The applicant’s complaints under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 to the Convention concerning the non ‑ enforcement of the final judgment issued on 20 May 2009 by the Bihor County Court, were communicated to the Romanian Government (“the Government”).

On 7 November 2023 the Court invited the parties to submit updated information about the pending procedure concerning the enforcement of the outstanding judgment. On 20 November 2023 the Government submitted that all outstanding obligations, including the payment of all costs and expenses incurred by the applicant in the enforcement proceedings, have been fully enforced on 25 November 2019. The applicant has not replied to the Court’s letter.

THE LAW

In view of the above, and having regard to its relevant established case ‑ law (see Văleanu and Others v. Romania , nos. 59012/17 and 27 others, §§ 202 ‑ 03, 8 November 2022) the Court considers that the matter has been resolved within the meaning of Article 37 § 1 (b) of the Convention and that respect for human rights as defined in the Convention and the Protocols thereto does not require it to continue the examination of the application under Article 37 § 1 in fine .

Accordingly, the application should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
