PRE-TRIAL CHAMBER II of the International Criminal Court issues this order to convene a hearing for the first appearance of Mr Maxime Jeoffroy Eli Mokom Gawaka (‘Mr Mokom’). 1. On 30 May 2014, the Government of the Central African Republic (the ‘CAR’) referred to the Prosecution a second situation in the CAR, concerning crimes under the 1 jurisdiction of the Court that may have been committed since 1 August 2012. 2. On 16 March 2018, the Presidency of the Court assigned the situation in the 2 Central African Republic II (the ‘CAR II Situation’) to Pre-Trial Chamber II. 3. On 30 October 2018, the Prosecution submitted an under seal, ex parte , application under article 58(7) of the Rome Statute (the ‘Statute’) requesting the issuance of a warrant of arrest for Mr Mokom. On 10 December 2018, the Chamber 4 issued the requested warrant of arrest. 4. Following his arrest in the Republic of Chad, Mr Mokom was surrendered to the Court on 14 March 2022, and arrived at the Detention Centre of the Court that same day. 5. Article 60(1) of the Statute and rule 121(1) of the Rules provide that an arrested person shall ‘promptly’ appear before the Pre-Trial Chamber and be informed of (i) the crimes he is alleged to have committed; (ii) his rights under the Statute; and (iii) the date for a hearing to confirm or to decline to confirm the charges. 6. Taking into account the precautionary measures in place at the Detention Centre in relation to COVID-19, which include a five day quarantine period, the Chamber schedules the first appearance of Mr Mokom for Tuesday 22 March 2022, at 14:30 5 hours.

7 Pursuant to regulation 21(1) of the Regulations of the Court, the publicity of hearings may extend beyond the courtroom. Video recording is therefore authorised, as well as briefly taking photographs by the Court’s photographer in the courtroom at the start of the hearing.
FOR THESE REASONS, THE CHAMBER HEREBY
CONVENES the first appearance of Mr Mokom on Tuesday, 22 March 2022, at 14:30 hours; AUTHORISES video recording and taking of photographs, as indicated in paragraph 7 above; and INSTRUCTS the Registry to notify Mr Mokom and, once appointed, his counsel, of this order.
