On 6 December 2019, at its 9th plenary meeting, the Assembly of State Parties to the Rome Statute of the International Criminal Court adopted by Resolution ICC-ASP/18/Res.5, in accordance with paragraphs 1 and 2 of article 121 of the Rome Statute of the International Criminal Court, an amendment to article 8 in order to insert a new article 8-2-e)-xix) relating to intentionally using starvation of civilians as a method of warfare by depriving them of objects indispensable to their survival, including willfully impeding relief supplies. In accordance with its article 121, paragraph 5, “[a]ny amendment to articles 5, 6, 7 and 8 of this Statute shall enter into force for those States Parties which have accepted the amendment one year after the deposit of their instruments of ratification or acceptance”.

Intentionally using starvation of civilians as a method of warfare by depriving them of objects indispensable to their survival, including willfully impeding relief supplies.
