U nderte cknat av Sverige den 31 maj 1974. Regeringen beslöt den 29 april 1976 att ratificera protokollet. Ratifika­ tionsinstrumentet deponerades i London den 28 juni 1976. Protokollet har ännu ej trätt i kraft.

PROTOCOL RELAT1NG TO INTERVENTION ON THE HIGH SEAS IN CASES OF MARINE POLLUTION BY SUBSTANCES OTHER THÅN OIL, 1973

THE PARTIES TO THE PRESENT PROTOCOL,

BEING PARTIES to the International Convention relating to Intervention on the High Seas in Cases of Oil Pollution Casualties, done at Brussels on 29 November 1969,

TAKING 1NTO ACCOUNT the Resolution on International Co-operation Concerning Pollutants other thån Oil adopted by the International Legal Conference on Marine Pollution Damage, 1969,

FU R T H E R TAKING INTO ACCOUNT that pursuant to the Resolution, the Inter-Governmental Maritime Consultative Organization has intensified its work, in collaboration with all interested international organizations, on all a s p e c ts o f pollu­ tion by substances other thån oil,

HAVÉ AGREED as follows:

A R T I C L E I

1. Parties to the present Protocol may take such measures on the high seas as may be necessary to prevent, mitigate or eliminate grave and imminent danger to their coastline or related interests from pollution or threat o f pollution by substances other thån oil following upon a maritime casualty or acts related to such a casualty, which may reasonably be expected to result in major harmful consequences.

2. “ Substances other thån oil” as referred to in paragraph 1 shall be:

(a) those substances enum erated in a list which shall be established b y an appropriate body designated by the Organization and which shall be annexed to the present Protocol, and

(b) those other substances which are liable to create hazards to human health, to harm living resources and marine life, to damage amenities or to interfere with other legitimate uses o f the sea.

3. Whenever an intervening Party takes action with regard to a substance referred to in paragraph 2(b) above that Party shall havé the burden o f establishing that the substance, under the circumstances present at the time o f the intervention, could reasonably pose a grave and im minent danger analogous to tha t posed by any o f the substances enumerated in the list referred to in paragraph 2(a) above.

DE FÖRDRAGSSLUTANDH PARTERNA,

SOM HAR TIL LTRÄTT den internationella konventionen om ingripande på det fria havet vid olyckor som är ägnade att leda till förorening genom olja, avslutad i Bryssel den 29 novem ber 1969,2

SOM BE.AKTAR den resolution om internationellt samarbete med avseende på andra förorenande ämnen än olja som antagits av 1969 års Internationella juridiska konferens om skador vid vattenförorening,

SOM JÄMVÄL BEAKTAR att den Mellanstatliga rådgivande sjöfartsorganisa­ tionen i enlighet med resolutionen har intensifierat sitt arbete, i samverkan med övriga intresserade internationella organisationer, i fråga om alla aspekter på förorening genom andra ämnen än olja.

HAR ÖVERENSKOMMIT om följande:

A R T I K E L I

1. De fördragsslutande parterna får på det fria havet vidtaga nödvändiga åtgärder för att förebygga, minska eller avvärja allvarlig och överhängande fara som förorening av havsvattnet genom andra ämnen än olja eller hot om sådan förorening innebär för deras kuster eller därtill k n utna intressen, om föroreningen eller hotet därom är en följd av en sjöolycka eller åtgöranden i samband med sådan olycka och om det är rimligt att antaga att mycket allvarlig skada uppkom m er därav.

2. "A ndra ämnen än olja" som avses i punkt 1 är

a) de ämnen som är upptagna i en förteckning vilken skall upprättas av ett av organisationen utsett särskilt organ och fogas som bilaga till detta protokoll, och

b) de äm nen i övrigt som kan innebära risker för människors hälsa, vara skadliga för levande tillgångar och den marina faunan och tloran, skada skönhets- och rekreationsvärden eller störa annat behörigt utn yttjande av havet.

3. Närhelst en ingripande fördragsslutande part vidtager åtgärd med avseende på ämne som avses i punkt 2 b) har denna part skyldighet att bevisa att ämnet under rådande förhållanden vid tiden för ingreppet skäligen kunde ge upphov tili allvarlig och överhängande fara likartad med den som framkallas av något av de äm nen som är upptagna i den förteckning som avses i p unkt 2 a).

1. The provisions o f paragraph 2 o f Article 1 and o f Articles II to VIII o f the Convention Relating to Intervention on the High Seas in Cases o f Oil Pollution Casualties, 1969, and the Annex thereto as they relate to oil, shall be applicable with regard to the substances referred to in Article I o f the present Protocol.

2. For the purpose o f the present Protocol the list o f experts referred to in Articles III(c) and IV o f the Convention shall be extended to include experts qualified to give advice in relation to substances other thån oil. Nominations to the list may be made by Member States o f the Organization and by Parties to the present Protocol.

A R T I C L E III

1. The list referred to in paragraph 2(a) o f Article I shall be maintained by the appropriate body designated by the Organization.

2. Any am endment to the list proposed by a Party to the present Protocol shall be submitted to the Organization and circulated by it to all Members o f the Organization and all Parties to the present Protocol at least three m onths prior to its consideration by the appropriate body.

3. Parties to the present Protocol whether or not Members o f the Organization shall be entitled to participate in the proceedings o f the appropriate body.

4. Amendments shall be adopted by a two-thirds majority o f only the Parties to the present Protocol present and voting.

5. If adopted in accordance with paragraph 4 above, the am endm e nt shall be com municated by the Organization to all Parties to the present Protocol for acceptance.

6. The am endment shall be deemed to havé been accepted at the end o f a period o f six month s after it has been communicated, unless within th at period an objection to the am endment has been communicated to the Organization by not less thån one-third o f the Parties to the present Protocol.

7. An am endment deemed to havé been accepted in accordance with para­ graph 6 above shall enter into force three month s after its acceptance for all Parties to the present Protocol. with the exception o f those which before that date havé made a declaration o f non-acceptance o f the said am endment.

A R T I C L E I V

1. The present Protocol shall be open for signature by the States which havé signed the Convention referred to in Article II or acceded thereto , and by any State invited to be represented at the International Conference on Marine Pollu­ tion, 1973. The Protocol shall remain open for signature from 15 Ja nuary 1974 until 31 December 1974 at the Headquarters o f the Organization.

2. För tillämpningen av detta protokoll skall den förteckning över sakkunniga som avses i artikel III punkt c) och artikel IV i konventionen utvidgas till att om fatta även sakkunniga som kan ge råd i fråga om andra ämnen än olja. Medlemmarna i organisationen och de fördragsslutande parterna kan föreslå nam n till förteckningen.

A R T I K E L III

1. Den förteckning som avses i artikel I punkt 2 a) skall hållas aktuell av det särskilda organet som utses av organisationen.

2. Ändring i förteckningen som föreslås av en fördragsslutande part skall överlämnas till organisationen och av denna delges alla organisationens medlemmar och alla fördragsslutande parter minst tre månader innan den behandlas av det särskilda organet.

3. Fördragsslutande parter skall, vare sig de är m edlem mar av organisationen eller ej, vara berättigade att deltaga i överläggningarna i det särskilda organet.

4. Ändringar skall antagas med två tredjedels majoritet uteslutande bland närvarande och röstande fördragsslutande parter.

5. Ändring som antagits enligt p unkt 4 ovan skall av organisationen överlämnas till alla fördragsslutande parter för godtagande.

6. Ändring skall anses som godtagen vid utgången av en tid av sex månader efter dess överlämnande, om organisationen ej under denna tid mottager invändningar från minst en tredjedel av de fördragsslutande parterna.

7. Ändring som skall anses som godtagen enligt punkt 6 träder i kraft tre månader efter den dag då den godtagits, med avseende på alla fördragsslutande parter uto m dem som före denna dag har förklarat att de ej godtager ändringen.

A R T I K E L IV

I . Detta protokoll står öppet för undertecknande av stater som undertecknat den konvention som avses i artikel II eller anslutit sig till denna och av varje stat som inbjudits till 1973 års Internationella konferens om havsföroreningar. P roto­ kollet skall vara öppet för undertecknande i organisationens lokaler från den 15 januari 1974 till den 31 december 1974.

2. Subject to paragraph 4 o f this Article, the present Protocol shall be subject to ratification, acceptance or approval by the States which havé signed it.

3. Subject to paragraph 4, this Protocol shall be open for accession by States which did not sign it.

4. The present Protocol may be ratified, accepted, approved or acceded to only by States which havé ratified, accepted, approved or acceded to the Convention referred to in Article II.

A R T I C L E V

1. Ratification, acceptance, approval or accession shall be effected by the deposit o f a formal instrument to that effect with the Secretary-General o f the Organization.

2. Any instrument o f ratification, acceptance, approval or accession deposited after the entry into force o f an am endment to the present Protocol with respect to all existing Parties or after the completion o f all measures required for the entry into force o f the am endment with respect to all existing Parties shall be deemed to apply to the Protocol as modified by the am endment.

A R T I C L E VI

1. The present Protocol shall enter into force on the ninetieth day following the date on which fifteen States havé deposited instruments o f ratification, acceptance, approval or accession with the Secretary-General o f the Organization, provided however that the present Protocol shall not enter into force before the Convention referred to in Article II has entered into force.

2. For each State which subsequently ratifies, accepts, approves or accedes to it, the present Protocol shall enter into force on the ninetieth day after the deposit by such State o f the appropriate instrument.

A R T I C L E VI I

1. The present Protocol may be denounced by any Party at any time after the date on which the Protocol enters into force för that Party.

2. Denunciation shall be effected by the deposit o f an instrument to th at effect with the Secretary-General o f the Organization,

3. Denunciation shall take effect one year, or such longer period as may be specified in the instrument o f denunciation, after its deposit with the Secretary- General o f the Organization.

4. Denunciation o f the Convention referred to in Article II by a Party shall be deemed to be a denunciation o f the present Protocol by that Party. Such denunciation shall take effect on the same day as the denunciation o f the Conven­ tion takes effect in accordance with paragraph 3 o f Article XII o f tha t Convention.

2. Om annat ej (oljer av punkt 4 i denna artikel skall detta protokoll vara föremål för ratificering, godtagande eller godkännande av de stater som underteck­ nat detsamma.

3. Om annat ej följer av p unkt 4 står detta protokoll ö ppet för anslutning av stater som ej undertecknat detsamma.

4. Detta protokoll får bli föremål för ratificering, godtagande, godkännande eller anslutning endast av stater som har ratificerat, godtagit, godkänt eller anslutit sig till den konvention som avses i artikel II.

ARTIKEL V

1. Ratificering, godtagande, godkännande eller anslutning skall verkställas genom deposition av e tt formellt instrument därom hos organisationens general­ sekreterare.

2. Instrument som avser ratificering, godtagande, godkännande eller anslutning och som deponeras, sedan ändring i d e t ta proto koll trätt i kraft för samtliga befintliga fördragsslutande parter eller sedan aila åtgärder har vidtagits som behövs för att ändringen skall träda i kraft för samtliga befintliga fördragsslutande parter, skall anses gälla protokollet i dess ändrade lydelse.

ARTIKEL VI

1. Detta protokoll träder i kraft nittio dagar efter den dag då femton stater hos organisationens generalsekreterare deponerat in strum ent avseende ratificering. godtagande, godkännande eller anslutning. Detta protokoll skall dock icke träda i kraft innan den konvention som avses i artikel II har trätt i kraft.

2. För stat, som därefter ratificerar, godtager, godkänner eller ansluter sig till detta protokoll, träder protokollet i kraft nittio dagar efter den dag då staten deponerat vederbörligt instrument.

ARTIKEL VII

1. Detta protokoll får av fördragsslutande part uppsägas när som helst sedan det trätt i kialt för denna fördragsslutande part.

2. Uppsägning skall verkställas genom att instrument därom deponeras hos organisationens generalsekreterare.

3. Ln uppsägning blir gällande ett år eller den längre tid, som kan vara angiven i uppsägningsinstrumentet, efter den dag dä instrumentet deponerats hos organisatio­ nens generalsekreterare.

4. Uppsägning av den konventio n som avses i artikel II av en fördragsslutande part skall anses vara en uppsägning av d etta protokoll av samma part. Sådan uppsägning blir gällande samma dag som uppsägningen av konventionen blir gällande enligt artikel XII punkt 3 i konventionen.

1. A conference for the purpose o f revising or amending the present Protocol may be convened by the Organization.

2. The Organization shall convene a conference o f Parties to the present Protocol för the purpose o f revising or amending it at the request o f not less th ån one-third o f the Parties.

A R T I C L E I X

1. The present Protocol shall be deposited with the Secretary-General o f the Organization.

2. The Secretary-General o f the Organization shall:

(a) inform all States which havé signed the present Protocol or acceded thereto of:

(i) each new signature or deposit o f an instrument to geth er with the date thereof; (ii) the date o f entry into force o f the present Protocol; (iii) the deposit o f any instrument o f denunciation o f the present Protocol together with the date on which the denunciation takes effect; (iv) any am endm ents to the present Protocol or its Annex and any objection or declaration o f non-acceptance o f the said amendment;

(b) transmit certified true copies o f the present Protocol to all States which havé signed the present Protocol or acceded thereto.

A R T I C L E X

As soon as the present Protocol enters into force, a certified true copy thereof shall be transm itted by the Secretary-General o f the Organization to the Secretariat o f the United Nations for registration and publication in accordance with Article 102 o f the Charter o f the United Nations.

A R T I C L E XI

The present Protocol is established in a single original in the English, French, Russian and Spanish languages, all four texts being equally authentic.

IN W1TNESS WHEREOF the undersigned being duly authorized for that purpose havé signed the present Protocol.

DONE AT LONDON this second day o f November one thousand nine hundred and seventy-three.

1. En konferens med uppgift att se över eller ändra detta protokoll kan sammankallas av organisationen. 2. På begäran av minst en tredjedel av de fördragsslutande parterna skall organisationen sammankalla en konferens av fördragsslutande parter med uppgift att se över eller ändra detta protokoll.

A R T I K E L IX

1. Detta protokoll skall deponeras hos organisationens generalsekreterare. 2. Organisationens generalsekreterare skall a) underrätta alla stater som har undertecknat detta protokoll eller anslutit sig till proto kollet om 1) varje n ytt undertecknande och varje ny deposition av ett instrument samt dagen för underte cknandet eller depositionen, 2) dagen för ikraftträdandet av detta protokoll, 3) deposition av instrument avseende uppsägning av d etta protokoll och den dag då uppsägningen blir gällande, 4 ) ändringar i detta protokoll eller dess bilaga och invändningar mot sådan ändring eller förklaring att fördragsslutande part ej godtager ändring, b) överlämna bestyrkta avskrifter av detta protokoll till alla stater som har underte cknat proto kollet eller anslutit sig till detsamma.

A R T I K E L X

Så snart detta protokoll trätt i kraft skall organisationens generalsekreterare överlämna texten till Förenta nationernas generalsekreterare för registrering och publicering enligt artikel 102 i Förenta nationernas stadga.

Detta protokoll är u pprättat i ett enda exemplar på engelska, franska, ryska och spanska språken1, varvid alla fyra texterna äger lika vitsord.
