SOM b eak tar att E u rato m sedan å r 1959 h a r g enom fört fleråriga forsknings- och utbildningsprogram inom o m råd et fö r styrd term o ­ nukleär fusion och plasm afysik, varvid arbetet enligt dessa program u t­ förs i enlighet m ed anslutningskontrakt; SOM b eaktar a tt dessa program h a r utgjort en del av en långsiktig sam arbetsplan, som o m fattar all verksam het i E uratom s m edlem sstater inom fusions- och plasm afysikom rådet och är avsedd a tt p å sikt leda fram till gem ensam konstruktion av p ro to ty p e r m ed sikte p å industriell tillverkning och m arknadsföring; SOM beaktar att E uratom förbereder ett fjärd e fem årigt forskningsoch utbildningsprogram inom ovannäm nda om råde fö r perioden 1976— 1980; SOM b eak tar att Sverige fö r sin del i m ånga å r h a r bedrivit forskning inom om rådet för styrd te rm onukleär fusion och plasm afysik och äger avsevärd kunskap inom det teknikom råde som hänger sam m an m ed så­ dan forskning; SOM inser, på grund av om fattningen av det arbete som å terstå r a tt utfö ra innan det stadium nås, d å styrd term o n u k leär fusion kan tillläm pas praktiskt, a tt d e t ligger i de avtalsslutande p arte rn a s intresse att fö ren a sina ansträngningar inom d etta o m råde för att u ndvika onödigt d u bbelarbete och påskynda sina respektive program , vilkas m ål h a r fått högre prio ritet till följd av energikrisen; H A R Ö V E R E N S K O M M IT OM F Ö L JA N D E :

E nligt d etta avtal ansluter de avtalsslutande p arte rn a det fo rsk ­ ningsprogram som i Sverige genom förs inom om rådet fö r styrd term o ­ nu k leär fusion och plasm afysik, nedan benäm nt ” det svenska p ro g ram ­ m et” , till E uratom s forsknings- och utbildningsprogram inom d etta om ­ råde, nedan benäm nt ” E u rato m p ro g ram m et” . 2. D et svenska program m et skall b idraga till E urato m p ro g ram m et ge­ nom a tt antaga dess långsiktiga m ål och sam arbetsform er. 3. E uratom program m et och det svenska program m et, vilka avses i första stycket i denna artikel, definieras var fö r sig i bilagorna I och II till d etta avtal. 4. sion and plasma physics

T H E E U R O P E A N A TOM IC E N E R G Y C O M M U N ITY , h ereinafter called “ E u ra to m ” , rep resen ted by th e C om m ission o f the E uropean Com m unities, hereinafter called “ the C om m ission” , A N D T H E G O V E R N ­ M E N T O F S W E D E N , W H E R E A S E uratom has, since 1959, been im plem enting m ultiannual research and training program m es in the field o f controlled therm o-nuclear fusion and plasm a physics, the w ork carried out under these program m es being perform ed u nder contracts of association; W H E R E A S th ese program m es havé form ed part of a long-term schem e of co-operation em bracing all activities in the field o f fusion and plasm a physics in th e M em ber S tates of E uratom , and havé been designed to lead in due course to the jo in t construction o f pro to ty p es with a view to the in­ dustrial production and m arketing; W H E R E A S E uratom is preparing a fourth five-year research and train ­ ing program m e in the above-m entioned field covering th e period 1976- 1980; W H E R E A S Sweden for its part has been carrying out research for m any years in the field of controlled therm o-nuclear fusion and plasm a physics, and possesses m ajor skills in the technological field associated with such re se a rc h ; R E C O G N IZ IN G th a t, owing to the scope o f th e w ork rem aining to be perform ed before reaching the stage at which controlled therm o-nuclear fusion can be applied in p ractice, it is in th e interest of the P arties to this A greem ent to com bine their efforts in this field with a view to avoiding unnecessary duplication and speeding up th eir respective program m es, w hose objectives havé gained greater priority as a result o f the energy crisis; H A V É A G R E E D AS FO LLO W S;

A rticle I 1. U nder this A greem ent, the contracting Parties associate the research program m e carried out in Sweden in the field o f controlled therm o-nuclear fusion and plasm a physics, hereinafter called “ the Swedish p rogram m e” , with th e E uratom research and training program m e in that field, herein- • after called “ the E uratom program m e” . 2. T he Swedish program m e shall contribute to the Euratom program m e by adopting its long-term objectives and m odes of co-operation. 3. T he Euratom programme and the Swedish program m e referred to in paragraph 1 o f this Article are defined respectively in the A nnexes I and II to this A greem ent. 4. T he Swedish program m e will be enlarged o r modified to include new activities relevant to the E uratom program m e w henever such activities arise.

A rticle II 1. T he objective o f this A greem ent is to enable each o f the C ontracting Parties to derive maximum benefit from th e resources assigned to th eir re-

m öjliga nytta av de resurser som ställs till förfogande för deras respek­ tive program och därigenom påskynda a tt E u ratom program m ets och det svenska program m ets gem ensam m a m ål uppnås, det vill säga a tt elektri­ citet produceras till konkurrenskraftiga priser genom utn y ttjan d e av kärnfusionsreaktioner. 2. D etta m ål skall uppnås m ed tilläm pning av villkoren i avtalet ge­ nom att: — v ardera parten på läm pligt sätt d eltar i den fas som o m fattar u ta r­ betande och genom förande av den an d ra partens program ; — p arte rn a öm sesidigt finansierar dessa program ; — p arte rn a öm sesidigt få r rä tt att ta del av de vetenskapliga och tekniska resultaten av dessa program .

A rtik e l l i l 1. E u rato m , fö reträd d av kom m issionen, skall sluta ett eller flera anslutningskontrakt m ed personer eller företag som utses av Sveriges rege­ ring, nedan kallade ” anslutna svenska o rgan” , för a tt u p p n å syftet m ed d etta avtal. 2. I den m ån det ä r m öjligt skall dessa k o n trak t överensstäm m a m ed k o n trak ten m ellan E u rato m och dess m edlem sstater, personer eller före­ tag i gem enskapen för genom förande av E uratom program m et. Särskilt gäller a tt genom kontrakten skall inrättas styrande kom m ittéer, som be­ stå r av befullm äktigade fö re träd are för kom m issionen och vederbö­ ran d e kontraktsslutande svenska organ. D essa styrande kom m ittéer skall ha till uppgift att: — tilläm pa anslutningskontrakten; — u ta rb e ta detaljinnehållet i de program som om fattas av sådana k o n trak t; — övervaka h u r forskningen fo rtsk rid er och styra den så att bästa m öjliga resultat nås i enlighet med d etta avtals syften.

A rtik e l I V 1. A nslutna svenska organ skall fö reträdas gem ensam t av högst två svenska delegater i sam bandsgruppen som är u p p rättad inom ram en för E u ratom program m et. Sam bandsgruppen, som h a r till u ppgitt att säker­ ställa inform ationsutbyte och sam arbete i frågor b eträffande pågående och föreslagna program och verksam heter inom E u ratom program m et, skall fullgöra denna uppgift fö r all den forskning och utveckling som avses i d etta avtal. D en skall särskilt säkerställa att sam arbetet och sam ­ ordningen m ellan anslutna lab o rato rier inom gem enskapen och i Sverige främ jas och styra deras arbete på fö r de två avtalsslutande p arte rn a bästa sätt m ot det gem ensam m a m ål som anges i E urato m p ro g ram m et och det svenska program m et sam t i artikel II i d etta avtal, varvid vederbörlig hänsyn skall tas till utvecklingen i världen i övrigt.

2. Sam bandsgruppen skall, n ä r vederbörande svenska m yndigheter så begär, m ed tilläm pning av sin arbetsordning utse en eller flera svenska fö re träd are i de rådgivande grupper som h ar inrättats för genom förande av E uratom program m et. D e rådgivande grupperna, som h a r till uppgift att för sam bandsgruppen lägga fram sådana forskningsförslag som ger största m öjliga vetenskapliga utbyte av de m edel som anslås till E u r­ atom program m et, skall fullgöra denna uppgift b eträ ffan d e all forskning och utveckling som avses i avtalet.

2. U nder the term s of this A greem ent, this objective will be attained by: - ap propriate participation by each o f the Contracting P arties in the phase involving preparation and im plem entation of the other P arty ’s p ro ­ gram m es; - reciprocal financing of those program m es; - reciprocal rights o f access to the scientific and technological results of those program m es.

A r tid e III 1. E uratom , represented by the Com m ission, shall conclude one o r m ore co n tracts o f association with the persons o r undertakings appointed by the Swedish G overnm ent, hereinafter called the “ associate Swedish b o d ies” , in o rd e r to attain th e objective of this A greem ent. 2. As f a r a s possible, these contracts shall be the same as those betw een Euratom and the M em ber S tates, persons o r undertakings o f the Com m unity for the im plem entation o f the Euratom program m e. In p articular, they shall set up steering com m ittees consisting o f appropriate representatives o f the Com m ission and of the appropriate contracting Swedish body or bodies. T he task o f these steering com m ittees shall be:

- to im plem ent the contracts of association; - to draw up details o f the program m es form ing the subject of such co n ­ tracts; - to supervise the developm ent o f th e research, and guide it so as to obtain the best possible results in accordance with the aims o f this A gree­ ment. A rtid e IV 1. T he associated Swedish bodies as a w hole shall be represented by not m ore thån tw o Swedish delegates on the Liaison G roup, hereinafter called “ the L G ” , set up within the fram ew ork of the Euratom program m e. The LG, w hose task is to ensure exchange of inform ation and co-operation in m atters concerning program m es and operations o r proposed program m es and operatio n s, within the scope of the E uratom program m e, shall perform that task with respect to all the research and developm ent activities referred to in this A greem ent. In particular, it shall ensure the prom otion o f co­ operation and co-ordination betw een the associated laboratories in the Com m unity and in Sw eden, and guide their w ork to the best advantage o f the tw o C ontracting Parties tow ards the com m on objective defined in th e Euratom program m e and the Swedish program m e and in A rticle II o f this A greem ent, with due regard to world trends. 2. In accordance with its rules of procedure, the LG shall appoint one or more Swedish representatives to the A dvisory G roups set up in im plem en­ tation o f the Euratom program m e, w henever the appropriate Swedish authorities so request. The Advisory G roups, which subm it research proposals to the LG with a view to obtaining maximum scientific benefit from the funds allocated under the Euratom program m e, shall perform th at task with respect to all the research and developm ent activities referred to in the A greem ent.

A rtik e l V 1. Svenska la boratorier som lyder u n d er anslutna svenska organ skall i den chefskom m itté, som h a r u p p rättats fö r E u ratom program m et, fö re­ träd a s av en laboratoriechef. C hefskom m ittén, som h a r ansvaret fö r övervakning av E uratom program m ets genom förande och fö r a tt de i program m et deltagande lab oratoriernas resurser utnyttjas p å b ästa sätt, skall fullgöra den n a uppgift b eträ ffan d e all den forskning och utveck­ ling, som avses i d etta avtal. D en skall särskilt säkerställa att personal u tnyttjas på bästa m öjliga sätt och a tt läm pligt personalutbyte m ellan de olika laboratorier, som d eltar i genom förandet av E u ratom program m et och det svenska program m et, äger rum .

2. Sverige h a r rä tt a tt ha en fö re träd are i v arje sam ordningskom m itté som u p prättas inom E u ratom program m et. Sam ordningskom m ittéerna, som har till uppgift att för chefskom m ittén lägga fram läm pliga förslag fö r a tt tillgängliga m edel, personal, kunskap och färdighet vid varje la­ boratorium som d eltar i genom förandet av E urato m p ro g ram m et skall kunna utnyttjas inom ett visst o m råde p å bästa m öjliga sätt, skall inom ifrågavarande o m råde fullgöra denna uppgift b eträ ffan d e all den forsk­ ning och utveckling som avses i d etta avtal.

A rtik el V I D e båd a avtalsslutande p arte rn a skall vara fö re träd d a i varje tekniskt rådgivande organ eller adm inistrativt organ som kan kom m a att inrättas fö r tilläm pningen av d etta avtal.

A rtik e l V II 1. E uratom skall om besörja att anslutna svenska organ blir p a rte r till följande ko n trak t som slutits av kom m issionen m ed dess associerade i gem enskapen: — Ö verenskom m elsen om utform ningen av JE T -projektet. — K o n trak tet rö ran d e utbyte av personal. 2. E uratom skall även säkerställa a tt de anslutna svenska organen kan bli p a rte r till ko n trak t vars syfte ligger i linje m ed d etta avtal med undantag för anslutningskontrakt eller liknande kontrakt, som E uratom ingår u nder detta avtals giltighetstid.

A rtik el V III D e u tlåtanden som avges av sam bandsgruppen, chefskom m ittén, de rådgivande grup p ern a och sam ordningskom m ittéerna skall vara av rå d ­ givande natur.

A rtik el I X 1. Sveriges finansiella bidrag enligt d etta avtal skall fastställas årligen till ett belopp som står i sam m a förhållande till E u rato m s andel av kost­ naderna fö r E uratom s program som Sveriges b ru tto n a tio n alp ro d u k t till sum m an av gem enskapens och Sveriges b ru tto n atio n alp ro d u k t u nder året närm ast före föregående år. 2. E uratom s finansiella bidrag till finansiering av arbete som utförs enligt de ko n trak t som avses i artik larn a III och V II skall beräknas på sam m a grundval som vanligen används vid beräkning av E uratom s bi­ drag till finansiering av arbete som utförs enligt m otsvarande ko n trak t under E uratom program m et.

A r tid e V 1. The Swedish laboratories under the autohority of the associated Swedish bodies shall be represented by a laboratory director on the Comm ittee o f D irectors set up under the Euratom program m e. The C om m ittee of D irectors, which is responsible for supervising the im plem entation of the E uratom program m e and making optim um use of the capacities o f the various laboratories taking part in the w ork thereunder, shall perform that task with resp ect to all the research and developm ent activities referred to in this A greem ent. In particular, it shall ensure optim um use of personnel and appropriate m ovem ent of the latter betw een the various laboratories engaged in the im plem entation o f the Euratom program m e and the Swedish program m e. 2. A Swedish representative shall havé the right to sit on any C o-ordinating C om m ittee set up under the Euratom program m e. The C o-ordinating C om m ittees, which present to the C om m ittee o f D irectors suitable proposals for th e optim um utilization in a particular sector, of the available funds, p ersonnel, knowledge and skills o f each laboratory concem ed in the im plem entation o f the Euratom program m e, shall perform that ta sk , for a particular secto r, with respect to all the research and developm ent a c ­ tivities referred to in this Agreem ent.

Article VI R epresentatives o f the tw o Contracting Parties shall take part in the w ork o f any technical advisory o f m anagem ent body that may be set up for th e pu rp o ses of this A greem ent.

A r tid e V II 1. E uratom shall arrange for the associated Swedish bodies to becom e parties to the following contracts concluded by the Com mission with its associates in th e Com munity: — The A greem ent for the design o f the JE T projekt; - The co n tra ct relating to mobility o f staff. 2. It shall also ensure th at the associated Swedish bodies may becom e parties to any contract the object o f which falls within the scope o f this A greem ent o th e r thån a contract o f association o r similar co n tra ct, which E uratom concludes during the period of this A greem ent.

A r tid e V III The opinions delivered by the LG , the C om m ittee of D irectors, the A d­ visory G roups and the Co-ordinating C om m ittes shall be of an advisory natu re .

A r tid e IX 1. The financial contribution o f Sw eden u nder this A greem ent shall be fixed annually a t a sum which bears the sam e relation to E u rato m ’s share o f th e co st o f EuratonT s program m e as the G ross N ational Product o f Sw eden bore to th e total G ross N ational P roduct of the Com m unity and o f Sw eden in th e last year beföra the previous year. 2. T he financial contribution o f E uratom to the financing of w ork carried out u n d er the con tracts referred to in A rticles l il and VII shall be calculated on the sam e basis as that norm ally used in calculating the contributions o f E uratom to the financing o f w ork carried out under the corresponding co n tracts under the Euratom program m e.

3. E uratom skall vid b örjan av varje år m eddela Sverige det belopp som beräknats fö r kostnaden fö r E urato m p ro g ram m et u n d er d etta år.

Sverige skall till kom m issionen erlägga d e t belopp som avses i denna artikel så att 7/12 erläggs före den 15 jan u ari och 5/12 före den 15 juli.

4. Sveriges regering skall vidtaga alla nödvändiga åtg ärd er fö r att sä­ kerställa a tt E u rato m skall v ara befriat frå n alla tullavgifter och an d ra avgifter sam t fö rb u d och restriktioner b eträ ffan d e im p o rt av varor som avses kom m a till användning i Sverige vid forsknings- och utveck­ lingsverksam het som faller inom ram en fö r d etta avtal. 5. Sveriges regering skall vidtaga alla nödvändiga åtg ärd er för att sä­ kerställa a tt E u rato m befrias frå n belastningen av ind irek ta skatter eller om sättningsskatter vilka annars skulle inbegripas i priset fö r lös eller fast egendom som E u rato m inköper i Sverige fö r a tt användas d ä r vid forsk­ nings- och utvecklingsverksam het inom ram en fö r d etta avtal. Befrielse skall ej m edges b eträffan d e skatter och pålag o r som endast utgör avgifter fö r tjänster frå n det allm ännas sida. 6. V aro r som im porteras till eller förvärvas i Sverige få r ej avyttras i Sverige, vare sig det sker m ot vederlag eller ej, m ed m indre det sker un ­ der villkor som godkänts av Sveriges regering. 7. D e tjänstem än vid de europeiska gem enskaperna som avses i arti­ kel 1 gem enskapernas personalstadga och ä r underkastade den inom gem enskaperna tilläm pade in te rn a beskattningen p å löner och an d ra er­ sättningar vilka utbetalas av gem enskaperna och som d eltar i forsk­ nings- och utvecklingsverksam het i Sverige inom ram en för d etta avtal, skall vara befriade frå n skatt i Sverige p å såd an a löner och an d ra er­ sättningar. D en i föregående stycke föreskrivna skattebefrielsen skall ej tilläm pas p å pensioner och livräntor som utbetalas av gem enskaperna till deras föru tv aran d e tjänstem än.

A rtik e l X 1. V ard era avtalsslutande parten s r ä tt a tt få tillgång till de veten­ skapliga resultaten av an d ra partens program skall utg ö ra en väsentlig del av d etta avtal. 2. D enna rä tt skall g aranteras genom : — regler om inform ation och p aten t vilka skall tilläm pas i enlighet m ed de allm änna principer som anges i artikel X I; — utbyte av personal m ellan lab o ra to riern a inom gem enskapen å ena och lab o rato riern a i Sverige å an d ra sidan; — rättvis fördelning m ellan svenska företag och företag inom ge­ m enskapen av beställningar som läggs u t fö r g enom förandet av de tv å anslutna program m en, varvid dock hänsyn skall tagas till principen att bästa m öjliga utbyte skall erhållas av anslagna m edel.

A rtik e l X I A. 1. Inform ation som h ä rrö r från forskningsprogram i Sverige enligt d etta avtal skall delges gem enskapens m edlem sstater sam t personer eller företag som u tfö r sådan forskning eller tillverkning inom någon av ge­ m enskapens m edlem sstater som gör det b erättig at att de få r tillgång till sådan inform ation.

3. Euratom shall at the beginning of each y ea r inform Sweden o f the am ount foreseen for the expenses concerning the Euratom program m e for th at year. Sweden shall pay to the Com mission the am ount due on the basis o f this A rtid e in the following stages: 7/12 before 15 January and 5/12 before 15 July. 4. The G overnm ent o f Sweden will take all m easures necessary to en ­ sure th at E uratom shall be exem pt from custom s duties and o th e r charges, prohibitions and restrictions on im ports in resp ect of a rtid e s intended to be used in Sw eden in the research and developm ent activities falling within the scope o f this A greem ent. 5. T he G overnm ent o f Sweden will take all m easures necessary to en ­ sure th a t E uratom is exem pted from th e burden o f indirect tax es o r sales taxes which would otherw ise be included in the price o f m ovable o r imm ovable property which Euratom purchases in Sweden for use therein in th e research and developm ent activities falling within the scope o f this A greem ent. N o exem ption shall be granted in respect o f taxes and dues which am ount m erely to charges for public utility services. 6. A rtid e s im ported into or acquired in Sw eden shall not be disposed of, w hether o r not in retu m for paym ent, in Sweden except under conditions approved by th e governm ent of Sweden. 7. Officials o f th e C om m unities within the meaning of A rtid e 1 of the Staff Regulations o f Officials of the E uropean Com m unities w ho are liable to intem al tax applied within the C om m unities on the salaries, wages and em olum ents paid by the Com m unities, and w ho are engaged in research and developm ent activities in Sw eden, falling within the scope o f this A greem ent, shall be exem pt in Sweden from tax on their salaries, wages and em olum ents. T he tax exem ptions provided for in the preceding subparagraph shall not apply in resp ect of pensions and annuities paid by the C om m unities to its fo rm er officials.

A r tid e X 1. Right o f access by each of the C ontracting Parties to the scientific results o f th e o th e r P arty 's program m e shall be an essential part o f this A greem ent. 2. It shall be guaranteed by: — rules on inform ation and patents w hich will apply in accordance with the general principles set out in A rtid e XI; — mobility o f sta ff betw een the laboratories in the C om m unity on the one hand and in Sweden on the o ther hand; — equitable sharing am ong Swedish industries and industries in the Com m unity o f orders placed for the im plem entation o f the tw o associated program m es, subject to the principle o f obtaining the best retu m for the sum s com m itted.

A r tid e X I A. 1. The inform ation resulting from research program m es u ndertaken in Sw eden u nder the term s o f this A greem ent shall be com m unicated to the M em ber S tates o f the Com m unity and to persons o r undertakings engaged in research o r production activities in the te rritory o f a M em ber S tate of the Com m unity w here such activities justify th eir access to such inform a­ tion.

2. Sådan inform ation skall ej delges an d ra stater, personer eller före­ tag annat än efter överenskom m else m ellan kom m issionen och anslutna svenska organ, utom om det sker till svenska regeringen eller till perso­ ner eller företag som i Sverige u tfö r sådan forskning eller tillverkning som gör det b erättigat a tt de få r tillgång till denna inform ation. B. Inform ation, som h ä rrö r från verksam het inom gem enskapen, dess anslutna organ eller dess uppdragstagare inom o m rådet fö r styrd term on ukleär fusion och plasm afysik u n d er d etta avtals giltighetstid, skall u n ­ d er sam m a villkor som gäller för m edlem sstater sam t för personer och företag inom gem enskapen delges svenska regeringen sam t personer el­ ler företag som i Sverige u tfö r sådan forskning eller tillverkning som gör det b erättigat a tt de få r tillgång till den n a inform ation. C. Skyddas inform ation som avses i p u n k te rn a A och B av patent, får den användas fö r forskningsändam ål av E uratom , svenska regeringen och deras anslutna o rgan och uppdragstagare för att u p p n å d etta avtals syften. G em enskapens m edlem sstater, svenska regeringen och personer eller företag inom gem enskapen eller i Sverige skall h a rä tt a tt erhålla li­ cens eller underlicens för att utny ttja sådana p aten t fö r industriella eller kom m ersiella ändam ål enligt skäliga villkor och bestäm m elser om E u r­ atom h a r rä tt a tt u p p låta sådana licenser eller underlicenser. D . (a) Inform ation, som h ä rrö r frå n verksam het som bedrivs av E u r­ atom , svenska regeringen, anslutna organ eller uppdragstagare före d etta avtals ikraftträd an d e, skall ställas till förfogande fö r de stater, personer och företag, till vilka den inform ation som avses i p u n k tern a A och B k an m eddelas i den utsträckning d etta ä r nödvändigt fö r a tt den infor­ m ation som d är avses skall kunna utnyttjas. (b) P atent, som h ä rrö r från sådan i föregående stycke avsedd verk­ sam het, skall ställas tili förfogande fö r de stater, personer och företag, vilka kan erhålla licens eller underlicens b eträffande p aten t som avses u n d er p unkt C i den utsträckning det ä r nödvändigt fö r a tt k u n n a u t­ n y ttja sådana licenser eller underlicenser. E. V ad som sägs i denna artikel får ej tolkas såsom innebärande in­ skränkning i de rättigheter som tillkom m er uppfinnare eller deras rätts­ innehavare enligt nationell rätt.

A rtik e l X I I 1. E tt gem ensam t organ som benäm nes Fusionskom m ittén Sverige- E u rato m skall inrättas. D et skall bestå av fö re träd are för E u rato m och Sverige. 2. Fusionskom m ittén Sverige-E uratom svarar fö r a tt avtalet tilläm pas p å rä tt sätt. 3. I d etta syfte kan Fusionskom m ittén S verige-Euratom särskilt, m ed stöd av u tlåtanden från sam bandsgruppen, avge rekom m endationer som skall delges de organ i gem enskapen och i Sverige, vilka ansvarar för program och b udgetar inom de forskningsom råden som täcks av d etta avtal. 4. Fusionskom m ittén S verige-E uratom skall sam m anträda p å be­ gäran av endera parten och m inst en gång om året. D en skall undersöka varje åtg ärd som ä r ägnad a tt fö rb ä ttra sam arbetet enligt avtalet och fortlö p an d e granska de fram steg som gjorts. A nser en d era avtalsslu­ tande parten att den an d ra parten h ar försum m at att uppfylla förplik­ telse enligt avtalet, skall den genast u n d errätta Fusionskom m ittén Sve­ rige-E uratom härom .

2. Such inform ation shall not be com m unicated to any o th e r S tates, p er­ sons o r undertakings except by agreem ent betw een the C om m ission and its Swedish asso ciates, unless it be to the Swedish G overnm ent o r to p er­ sons o r undertakings carrying out in Sweden research o r production activities which justify th eir access to such inform ation. B. Inform ation resulting from the activities o f the Com m unity, its a sso ­ ciates o r its co n tra cto rs in the field o f controlled therm o-nuclear fusion and plasm a physics during the term of this A greem ent shall be com m unicated to the Swedish G overnm ent and to persons o r undertakings carrying o ut, in S w eden, research o r production activities which justify their access to such inform ation on the sam e conditions as to M em ber S tates, persons and undertakings in the Com m unity. C. If the inform ation referred to in sections A and B is p ro tec ted by p aten ts, the la tte r may be used for research purposes by E u rato m , th e Swedish G overnm ent and their associates and contractors in pursuing the aims o f this A greem ent. The M em ber States o f the C om m unity, the S w ed­ ish G overnm ent and persons or undertakings established in the C om m uni­ ty o r in Sw eden shall havé the right to obtain licences or sublicences for the exploitation o f such patents for industrial o r com m ercial purposes on appropriate term s and conditions, w here E uratom has the right to grant such licences o r sublicences. D. (a) The inform ation resulting from activities carried out by E uratom , the Swedish G overnm ent and their associates o r contractors prior to the entry into force of this Agreem ent shall be m ade available to those S tates, persons and undertakings to which the inform ation referred to in sections A and B may be com m unicated to the extent n eceassary for the use o f the inform ation, referred to in those sections. (b) P atents resulting from activities referred to in the previous subparagraph shall be m ade available to those S tate s, persons and u n d erta k ­ ings which can obtain a licence o r sublicence in respect o f th e p atents re ­ ferred to in section C to the extent necessary for the use of such licences o r sublicences. E. This article does not affect any rights u nder national laws o f inventors o r their successors in title.

A rticle X II 1. A Joint Body which will be called the “ Euratom /Sw eden Fusion Com m ittee " shall be set up, consisting on th e one hand of representatives of Euratom and on the o ther hand o f represen tativ es o f Sweden. 2. T he E uratom /Sw eden Fusion C om m ittee shall be responsible fo r ensuring th at this A greem ent is properly im plem ented. 3. F o r this purpose the E uratom /Sw eden Fusion C om m ittee m ay, in particular, on the basis of opinions delivered by the L G , m ake recom m endations w hich shall be com m unicated to th e authorities in th e Com m unity and in Sweden which are responsible for adopting program m es and b u d ­ gets in the fields o f research covered by this A greem ent. 4. T he E uratom /Sw eden Fusion C om m ittee shall m eet at the req u est of either o f the P arties, and not less thån once a year. It shall exam ine any m easures likely to im prove co-operation under this A greem ent and keep under review the progress m ade. If one of the C ontracting P arties considers that the o th e r C ontracting Party has failed to com ply with an obliga­ tion under the A greem ent, it shall notify the E uratom /Sw eden Fusion C om m ittee forthw ith.

5. F usionskom m ittén S verige-Euratom skall an tag a sin egen arbets­ ordning. 6. O rdförandeposten skall innehas av de avtalsslutande p arte rn a i tur och ordning i enlighet med kom m itténs arbetsordning.

A rtik e l XI I I 1. T vister rörande tolkning eller tilläm pning av d etta avtal skall på begäran av en d era avtalsslutande p arte n hänskjutas till skiljenäm nd. 2. D en skiljenäm nd som avses i första stycket skall tillsättas för varje särskilt fall. D en skall bestå av tre ledam öter. V ard era avtalsslutande p arten skall utse en ledam ot och dessa tv å skall gem ensam t utse den tredje ledam oten, som skall vara näm ndens o rdförande. F ö rsu m m ar av­ talsslutande p art a tt utse ledam ot av näm nden inom två m ån ad er från d et begäran om a tt en tvist skall hänskjutas till näm nd fram ställts eller har, inom en m ånad e fte r det a tt dessa två skiljem än utsetts, de två leda­ m öterna ej kun n at enas om utseende av den tredje ledam oten, skall den avtalsslutande parten eller de avtalsslutande p arte rn a hem ställa a tt p re ­ sidenten i internationella dom stolen utser läm plig ledam ot. 3. Som skiljenäm ndens beslut gäller den m ening varom de flesta fö r­ en a r sig. Beslut skall vara bindande. V ard era avtalsslutande parten skall bära kostnaderna för sin egen ledam ot i skiljeförfarandet; kostnaderna fö r ord fö ran d en och de återstående kostnaderna skall bäras till lika delar av båda de avtalsslutande parterna.

A rtik e l X I V 1. D etta avtal skall godkännas av de avtalsslutande p arte rn a enligt deras egna förfaranden. D et skall trä d a i k raft n ä r p arte rn a h ar u n d er­ rättat v ara n d ra om a tt de h ä rfö r erforderliga fö rfaran d e n a slutförts, dock ej före 1 jan u ari 1976. 2. A vtalet ingås för den tid som bestäm s av det E urato m p ro g ram vil­ ket anges i artikel I och förlängs autom atiskt i enlighet m ed de beslut om efterföljande program som gem enskapen kan kom m a att fatta. N är sådant program beslut fattas, skall förlängningen avse den tid som gäller för det nya program m et och E urato m p ro g ram m et i bilaga I bytas ut m ot d etta nya program . A vtalet skall ej anses u p p h ö ra endast p å grund av försening vid antagandet av något efterföljande E uratom program . 3. A vtalsslutande p a rt kan n ä r som helst säga upp avtalet m ed sex m ånaders uppsägningstid. Som skedde i Bryssel den 10 maj 1976 i två exem plar på svenska, dans­ ka. engelska, franska, italienska, nederländska och tyska språken, vilka te x ter äger lika vitsord. 5. The E uratom /Sw eden Fusion C om m ittee shall adopt its own rules of proc edu re. 6. The Office o f C hairm an shall be held by each o f the C ontracting Parties in turn. in aecordance with the rules o f procedure o f the E u rato m /S w e­ den Fusion C om m ittee.

A r tid e XII I 1. D isputes regarding the interpretation o r application of this A greem ent shall, upon the req u est of either C ontracting P arty, be subm itted to a B oard of A rbitrators. 2. The B oard of A rbitrators referred to in paragraph 1 shall be established for each individual case. It shall be com posed of th ree m em bers. Each C ontracting Party shall appoint one m em ber and these tw o m em bers shall agree upon the appointm ent of the third m em ber, who shall be the Charim an of the Board. If a C ontracting Party fails to appoint a m em ber of the B oard within tw o m onths o f the req u est for subm ission o f a d ispute to a Board, or if within one month of the appointm ent o f the second m em ber o f a B oard, the tw o m em bers o f the Board do not reach agreem ent on th e ap ­ pointm ent o f the third m em ber, the C ontracting Party o r the C ontracting Parties, as the case may be, shall invite the P resident o f the International Court o f Justiee to appoint the appropriate m em ber. 3. The Board o f A rbitrators shall reach its decision by a m ajority of votes. Such decisions shall be binding. Each C ontracting Party shall b ea r the co sts o f its own m em ber in the arbitral proceedings; the costs o f the Charim an and th e rem aining costs shall be borne in equal p arts by both C ontracting Parties.

A r tid e X IV 1. This A greem ent will be approved by the P arties in accordance with their own procedures. It shall en ter into force w hen the Parties havé notified each o ther that the procedures n ecessary to this end havé been com pleted, but not before 1 January 1976. 2. This A greem ent is concluded for the period covered by the E uratom program m e referred to in Article 1 and will be tacitly extended in keeping with any subsequent program m e decision which the Com m unity may take on the m atter. W henever such a subsequent program m e decision is taken, th e extension will havé effect for the period covered by the new program m e and that new programme will be substituted for the E uratom program m e in A nnex I. This A greem ent shall be deem ed not to com e to an end only by virtue of a delay in the enactm ent of any subsequent Euratom program m e. 3. E ither C ontracting Party may term inate this A greem ent by giving six m onths’ notice at any tim e.

The future E uratom program m e, w hich will sta rt on 1 January 1976, will en su re, in conform ity w ith the decisions w hich the C ouncil o f the European C om m unities will reach, the logical developm ent o f the preceding program m e. This program m e is part o f a long term co-operative project em bracing all work carried out in the M em ber S tates in the field o f fusion and plasm a physics. It is designed to lead in due course to the jo in t co nstruction of p rototypes with a view to th eir industrial-scale production and m arkering.

A n n e x II The subject m a tte r o f the Swedish program m e will be based on activities on th e following lines: - basic plasm a research concem ing m ovem ent o f charged particles in electrom agnetic fields, States of equilibrium and dynam ics o f a plasm a, phenom ena o f instability and w aves, heating o f a plasm a gas-plasm a interaction and non-therm al phenom ena.
