JA PA N Based on the provisions o f Article 13 o f the C ustom s T ariff Law , he who w ants to im port, with custom s duty exem pted, skim med milk pow der so as to produce animal feed through mixing the pow der concerned with o ther m aterials shall take the following steps so that the pow der concerned will not be diverted to uses o th e r thån animal feed: (1) He shall in advance m ake an application to the D irector o f C ustom s Office so that his factory be authorized to produce mixed feed with the duty-exem pted skim med milk pow der. (2) W hen he (him self or through his agent) im ports skim med milk pow der for purposes o f animal feed, he shall go through necessary im portation form alities and custom s officers at a port o f entry shall keep a record on the quantity o f the skim med milk pow der thus im ported. (3) H e shall deliver the skim med milk pow der to his factory authorized u nder paragraph I above and mix it with fish m eal, chrysalis meal or fish soluble. (4) A fter producing mixed feed, he shall subm it, for inspection by the C ustom s O ffice, a report which contains, am ong others,inform ation on the q u antities o f the skim med milk pow der used in the production and o f o ther m aterials mixed therew ith. The custom s officers shall check how m uch o f the quantity recorded at the tim e o f entry has been used in the production and inspect the product concerned before its deli very from the factory. In cases w here he violates the control m easures m entioned above, the authorization under paragraph 1 above shall be cancelled and the exem pt ed custom s duty shall be collected according to the provisions o f the C ustom s T ariff Law . In addition to the above, he shall be fined o r imprisoned, as the case may be, on the ground o f the evasion o f custom s duty as provided for by the C ustom s Law.

The denaturing o f skim med milk pow der is to be effected by either o f the following tw o processes: ( 1) H om ogeneous addition to the products to be denatured o f 1 per cent o f blood flour and I per cent o f fish flour17; both substances m ust be finely ground, and each must pass through a N o. 60 screen o f the T yler fine series (0.246 millimetre m esh) o r its standard equivalents, in a proportion o f not less thån 80 per cent. T he blood flour shall be o f a type regarded as soluble in the trade and m ust meet the requirem ent that w hen diluted in w ater in a 10 per cent solution and when the solution is shaken for fifteen m inutes and centrifuged for an additional fifteen m inutes at 2,000 revolutions per m inute, the sedim ent shall not exceed 5 per cent. (2) H om ogeneous addition to the products to be denatured o f 1 per cent of blood flour and 1 per cent o f non-deodorized fish solubles. M inistry o f A griculture O rder o f 30 O ctaber 1976 establishing control a n d surveillance o f d en a tured m ilk pon der and whey p on der f o r use in anim al fe e d T he im port o f denatured milk pow der o r w hey pow der under the Liberalized-T rade Regime exclusively for purposes o f animal feed requires regulation o f the control and surveillance o f use, with the twofold objective o f guaranteeing the quality o f both the basic product and the denaturing agents em ployed and o f preventing unlawful com petition with dom estic dairy products. Q uality standards and requirem ents for substances and products used in anim al feed having been approved by Decree 851/1975 o f 20 M arch and M inisterial O rder o f the M inister o f A griculture o f 23 June 1976, it is n ecessary to m ake an order regarding procedures for testing and dem anding the necessary quality in those products. In pursuance o f the instructions contained in Article 21 o f the said D ecree regarding the control and surveillance to be exercised by the M inistry o f A griculture ö ver the handling, tran sp o rt and storage o f pro ducts for use in animal feed and by virtue o f the authority vested in this D epartm ent by final provision 4 of the said D ecree,I havé deem ed it fitting to provide as follows; A rticle I . The denatured milk pow der and w hey pow der to be im ported m ust m eet the quality requirem ents laid dow n for those products in the M inisterial O rd er o f 23 June 1976, taking into account any m odifications in those ch aracteristics which may result from the denaturing agent used.

The products used as denaturing agents may be those approved by Circular N o. 543 o f the G eneral D irectorate o f C ustom s (Boletin Oficial del E stado o f 28 July 1966) o r such o ther products as may subsequently be approved for the purpose. The foregoing shall be tested by m eans o f analyses perform ed by laboratories belonging to this D epartm ent on sam pies taken, prior to custom s clearance, by the appropriate inspection services from the lots being im ported. A rticle 2. In o rder to ensure adequate preservation o f the quality o f these pro d u cts, they m ay only be im ported in sacks. Im ported denatured dairy products shall be used exctusively in anim al feed and accordingly, after clearance by C ustom s, they shall be consigned exclusively to fodder o r additive plants, Wholesale w arehouses o r stock-farm ers, all o f w hom shall p reserve the docum entation accom pa nying the goods since its entry in Custom s. The subsequent m ovem ent of these products shall be restricted to authorized industrial and w arehousing e n terp rises, w hich must ensure that the goods are alw ays accom panied by docum ents o r invoices certifying the origin thereof. The consignee o f the goods shall hold the original o f these docum ents at the disposal o f the inspection services for one year, and the consignor shall hold the copy o r counterfoil for the same period o f tim e and for the sam e purpose. A rticle 6. The rem oval o r total o r partial elim ination o f the denaturing substances incorporated in the dairy products referred to in this O rder, and likewise any o th e r practice that would annul effects indicative o f the p resence o f such substances, shall be prohibited. A rticle 7.
