Konungariket Sveriges regering och de Socialistiska Rådsrepublikemas Unions regering, nedan kallade de fördragsslutande partem a, som önskar befasta och vidareutveckla de vänskapliga förbindelserna mellan de båda länderna och deras folk på grundval av folkrättens princi­ per såsom dessa bland annat bekräftas i slutakten från konferensen om säkerhet och samarbete i Europa av den 1 augusti 1975, som beaktar bestämmelserna i 1979 års internationella sjöräddnings­ kon vention och i bilaga 12 till 1944 års konvention angående internatio­ nell civil luftfart, som är medvetna om att en snabb hjälpinsats kan vara av avgörande betydelse för personer i nöd på eller över havet, har överenskommit om följande:

Artikel 1 Vid tillämpningen av denna överenskommelse skall begreppen och defi­ nitionerna i kapitel 1 i bilagan till 1979 års internationella sjöräddnings­ kon vention och i kapitel 1 i bilaga 12 till 1944 års konvention angående internationell civil luftfart äga tillämpning.

Artikel 2 1. De fördragsslutande partem a överenskommer att betrakta gränsen mellan sina till varandra gränsande flyginformationsregioner (FIR) som gräns mellan sina sjö- och flygräddningsregioner. Denna avgränsning av sjö- och flygräddningsregionema mellan Konungariket Sverige och de Socialistiska Rådsrepublikemas Union påverkar inte andra gränsdrag­ ningar mellan de båda staterna.

Agreement between the Government of the Kingdon of Sweden and

the Government of the Union of Soviet Socialist Republics concer-

ning Co-operation in respect of Maritime and Aeronautical Search

and Rescue in the Baltic Sea

The Government of the Kingdom of Sweden and the Government o f the Union of Soviet Socialist Republics, hereinafter referred to as the Contracting Parties, determined to strengthen and further develop the friendly relations between both States and peoples on the basis o f the principles o f interna­ tional law, as confirmed inter alia in the Final Act o f the Conference on Security and Co-operation in Europé dated 1 August 1975, taking into account the provisions o f the International Convention on Maritime Search and Rescue, 1979, and o f Annex 12 to the Convention on International Civil Aviation, 1944, aware of the vital importance that rapid assistance may havé for persons in distress on or över the sea, havé agreed as follows:

Article 1 For the purpose o f this Agreement the terms and definitions contained in Chapter 1 o f the Annex to the International Convention on M aritime Search and Rescue, 1979, and in Chapter 1 o f Annex 12 to the Convention on International Civil Aviation, 1944, shall be applicable.

A rtide 2 1. The Contracting Parties agree to regard the boundary between their adjacent flight information regions (FIR) as the boundary between their search and rescue regions for maritime and aeronautical purposes. This delimitation o f the search and rescue regions between the Kingdom of Sweden and the Union o f Soviet Socialist Republics does not prejudice the delimitation o f any other boundary between the two States.

2. Vardera fördragsslutande parten säkerställer att det finns fullgoda sjö- och flygräddningstjänster, i det följande benäm nda räddningstjänster­ na, med avseende på den egna sjö- och flygräddningsregionen. 3.De fördragsslutande parternas behöriga myndigheter anger vilka or­ gan som är ansvariga för samarbetet med den andra fördragsslutande partens räddningstjänster.

Artikel 4 Räddningsinsatser i eller över endera fördragsslutande partens territorialhav, inre vatten och landområden skall genomföras i enlighet med den fördragsslutande partens lagar och förordningar, vilka antagits i överens­ stämmelse med 1979 års internationella sjöräddningskonvention och bila­ ga 12 till 1944 års konvention angående internationell civil luftfart.

2. Each Contracting Party ensures that adequate maritime and aeronautical search and rescue services, hereinafter referred to as search and rescue services, are available in respect o f its search and rescue region. 3. The competent authorities o f the Contracting Parties shall designate the services which are responsible for the co-operation with the search and rescue services o f the other Contracting Party.

Article 3 The competent authorities of the Contracting Parties are: - In the Kingdon of Sweden: the National M aritime in respect o f maritime Administration search and rescue The Swedish Civil Aviation in respect of Administration aeronautical search and rescue - In the Union o f Soviet Socialist Republics: the USSR Ministry o f in respect o f maritime Merchant Marine search and rescue the USSR Ministry of in respect of Civil Aviation aeronautical search and rescue

A rtide 4 Search and rescue operations in and över the territorial sea, intemal waters and land o f either Contracting Party shall be conducted in accordance with the laws and regulations o f that Contracting Party adopted in conformity with the International Convention on M aritim e Search and Rescue, 1979 and Annex 12 to the Convention on International Civil Aviation, 1944.

1. Erhåller den ena föredragsslutande partens räddningstjänst känne­ dom om att människoliv förmodas vara i fara på eller över Östersjön i fördragsslutande partens sjö- och flygräddningsregion, skall denna rädd­ ningstjänst omedelbart vidta alla erforderliga åtgärder för efterforskning och undsättning. 2. Erhåller den ena fördragsslutande partens räddningstjänst kännedom om att människoliv är eller förmodas vara i fara på eller över Östersjön i den andra fördragsslutande partens sjö- och flygräddningsregion, skall denna räddningstjänst omedelbart underrätta den andra fördragsslutande partens räddningstjänst. 3. Om den räddningstjänst som har erhållit kännedom om en situation som avses i punkt 1 i denna artikel finnér att bistånd av den andra fördragsslutande partens räddningstjänst behövs, får sådant bistånd begä­ ras. Den räddningstjänst som har mottagit en sådan begäran skall i största möjliga utsträckning lämna bistånd. I detta fall skall fortsatta åtgärder vidtas i samarbete mellan de båda fördragsslutande parternas räddnings­ tjänster. 4. Bistånd skall lämnas varje person som är eller förmodas vara i nöd på eller över havet, utan hänsyn till personens nationalitet eller status eller till de omständigheter under vilka denna påträffas. 5. Varje fördragsslutande part skall informera den andra fördragsslu­ tande partens diplomatiska eller konsulära representation om räddning av överlevande eller om upptagning av om kom na personer med sistnämnda fördragsslutande parts medborgarskap. Informationen skall ges utan dröjs­ mål och skall såvitt möjligt innehålla efternamn, förnamn, födelsedatum, hemortsadress, pass- eller sjöfartsboknummer samt uppgifter om de över­ levandes hälsotillstånd och uppehållsort eller den plats där den avlidnes kropp förvaras.

1. If the search and rescue service o f one of the Contracting Parties receives information to the effert that human life is, or is believed to be, in danger on or över the Baltic Sea in that Contracting Party’s search and rescue region, that service shall without delay take all necessary search and rescue measures. 2. If the search and rescue service o f one o f the Contracting Parties receives information to the effert that human life is, or is believed to be, in danger on or över the Baltic Sea in the search and rescue region o f the other Contracting Party, that service shall without delay inform the search and rescue service o f the other Contracting Party. 3. If the search and rescue service that has received information about a situation as referred to in paragraph 1 of this Article considers assistance from the search and rescue service of the other Contracting Party necessa­ ry, it may request such assistance. The search and rescue service that has received such a request shall render assistance to the utmost possible extent. In this case, further measures shall be taken in co-operation between the search and rescue services o f both Contracting Parties. 4. Assistance to any person in danger, or beleived to be in danger, on or över the sea shall be rendered regerdless o f the nationality or status of such a person or the circumstances in which that person is found. 5. Each Contracting Party shall inform the diplomatic or consular re­ presentation o f the other Contracting Party about the rescue o f survivors, or the retrieval of perished persons with citizenship of the other Contrac­ ting Party. The information shall be provided without delay and shall as far as possible, include sumame, first name, date o f birth, home address, num ber o f passport or seaman’s discharge book as well as details about the state o f health and the whereabouts o f survivors or the place where the body o f the deceased is retained.

Artikel 6 1. De fördragsslutande parterna överenskommer om att befästa samar­ betet mellan varandras sjö- och flygräddningstjänster. Detta samarbete skall bland annat om fatta gemensamma räddningstjänstövningar, regel­ bundna kontroller av de mellanstatliga kommunikationskanalerna, kon­ taktbesök av experter vid räddningstjänsterna samt utbyte av information om och erfarenheter av räddningstjänsterna. 2. De fördragsslutande parternas behöriga myndigheter skall utarbeta och komma överens om ett protokoll om samarbete för det praktiska genomförandet av denna överenskommelse. 3. Företrädare för de föredragsslutande parternas behöriga myndigheter skall, när så är nödvändigt, träffas omväxlande i Konungariket Sverige och de Socialistiska Rådsrepublikemas Union för att behandla och besluta i frågor som rör praktiskt samarbete.

Artikel 7 Vaije föredragsslutande part skall bära de kostnader som uppkom m er i samband med dess deltagande i räddningsinsatser i enlighet med denna överenskommelse.

Artikel 8 Inget i denna överenskommelse skall på något sätt påverka någondera fördragsslutande parts rättigheter och skyldigheter, vilka härrör från andra bilaterala eller multilaterala internationella överenskommelser.

Artikel 9 Ändringar i denna överenskommelse kan överenskommas mellan de fördragsslutande parterna och skall ske i skriftlig form.

A rtide 6 1. The Contracting Parties agree to strengthen the co-operation between each ofher’s search and rescue services. Such co-operation shall inter alia include: joint search and rescue exercises, regular checks on inter-State communication channels, liaison visits by search and rescue experts and the exchange of search and rescue information and experience. 2. The competent authorities o f the Contracting Parties shall develop and agree upon a protocol on co-operation for the practical implementation o f this Agreement. 3. In order to consider and decide on matters o f practical co-operation, representatives o f the contracting Parties’ competent authorities will meet, when necessary, alternately in the Kingdom of Sweden and in the Union o f Soviet Socialist Republics.

A rtide 7 Each Contracting Party shall bear the expenses incurred by its participa­ tion in search and rescue operation in conformity with this Agreement.

A rtide 8 Nothing in this Agreement shall alfert in any way the rights and obliga­ tions o f either Contracting Party, arising from better bilateral or multila­ teral international agreements.

A rtide 9 Amendments to this Agreement may be agreed upon by the Contracting Parties and shall be made in written form.

Artikel 10 1. Denna överenskommelse träder i kraft trettio dagar efter det att de fordragsslutande parterna skriftligen underrättat varandra om att de kon­ stitutionella kraven för överenskommelsens ikraftträdande uppfyllts. 2. Från samma dag skall överenskommelsen mellan Sveriges regering och De Socialistiska Rådsrepublikemas Unions regering om samarbete för räddning av människoliv i Östersjön, undertecknad i Moskva den 29 september 1954 och protokollet till denna överenskommelse, underteck­ nat i Stockholm den 14 oktober 1981, upphöra att äga giltighet. 3. Denna överenskommelse skall förbli i kraft fram till en tidpunkt sex månader efter det att den uppsagts av endera fordragsslutande parten i skriftlig form. Upprättad i Moskva den 24 maj 1989 i två likalydande exemplar, vardera på svenska, ryska och engelska språken, varav samtliga texter äger lika vitsord.

Article 10 1. This Agreement shall enter into force thirty days after the date when the Contracting Parties havé notified each other in writing that the necessary internal procedures havé been completed. 2. From the same day the Agreement between the Governm ent of Sweden and the Government of the Union o f Soviet Socialist Republics on co-operation for the rescue o f human life in the Baltic Sea signed in Moscow on 29th September 1954 and the Protocol to it signed in Stock­ holm on 14th October 1981 shall cease to be effective. 3. This Agreement shall remain in force until it is denounced by either Contracting Party upon six m onths’ advance notice in writing to the other Contracting Party.
