The G en eral C onference o f the In tern atio n al L ab o u r O rganisation. H aving been convened at G en ev a by the G overning B ody o f the In tern atio n al L ab o u r Office, and having m et in its Seventy-fourth Session on 24 S ep tem ­ b er 1987, and Recalling the provisions of the S eam en ’s W elfare in Ports R ecom m endation. 1936, and the S eafarers’ W elfare R eco m m en d atio n . 1970. and

H aving decided upon the ado p tio n o f certain proposals with regard to seafarers' w elfare at sea and in p o rt which is the second item on the agenda of the session, and H aving determ in ed that these proposals shall take the form o f an in ternational C o n v e n tio n , ad o p ts this eighth day o f O c to b er o f the year one th ousand nine h u ndred and eighty-seven the following C onvention which may be cited as the S eafarers’ W elfare C o n v en tio n , 1987:

A rticle 1

1. F o r the purposes o f this C o n v e n tio n - (a) the term “ se a fa re r" m eans any p erso n w ho is em ployed in any capacity on b o a rd a seagoing ship, w h eth er publicly o r privately ow ned, o th e r thån a ship o f w a r ; (b) the term “ w elfare facilities and services" m eans w elfare. cu ltu ral. recreational and inform ation facilities and services. 2. E ach M em b er shall d eterm in e by n ational laws o r regulations. after consul­ tation with the rep resen tativ e organisations o f shipow ners and seafarers. which ships registered in its territo ry are to be reg ard ed as seagoing ships for the purpose of the provisions o f this C onv en tio n relating to w elfare facilities and services on b o ard ship. 3. To the extent it deem s p racticable, a fte r co nsultation with the re p re se n ta ­ tive o rganisations o f fishing vessel ow ners and fisherm en. the co m p eten t authority shall apply the provisions o f this C onv en tio n to com m ercial m aritim e fishing.

A rticle 2

1. E ach M em b er för which this C onv en tio n is in force u n d e rta k es to ensure th at ad eq u ate w elfare facilities and services are provided for seafarers both in port and on b o ard ship.

2. E ach M em b er shall ensure th at the necessary arran g em en ts are m ade for financing the w elfare facilities and services provided in accordance with the provisions o f this C onvention.

Article 3

1. E ach M em b er u n d ertak es to ensure th at w elfare facilities and services are provided in a p p ro p ria te po rts o f the country for all seafarers. irrespective of nationality, race, colour. sex, religion, political o pinion o r social origin and irrespective o f the S tate in which the ship on which they are em ployed is regis­ tered . 2. E ach M em b er shall d eterm in e, after co nsultation w ith the rep resen tativ e o rganisations o f shipow ners and seafarers, w hich po rts are to be reg ard ed as a p p ro p ria te for the purposes of this A rticle.

E ach M em b er u n d ertak es to ensure th at the w elfare facilities and services on every seagoing ship. w hether publicly o r privately ow ned, which is registered in its territo ry , are provided for the benefit o f all seafarers on b o ard .

A rticle 5 W elfare facjlities and services shall be review ed frequently to ensure th at they are ap p ro p ria te in the light of changes in the needs o f seafarers resulting from technical, op eratio n al and o th e r developm ents in the shipping industry.

A rticle 6 E ach M em b er u n d e rta k e s - (a) to co -o p erate with o th er M em bers with a view to ensuring the application of this C o n v e n tio n ; and (b) to ensure co-operation betw een the p arties engaged and in terested in prom oting the w elfare of seafarers at sea an d in port.

A rticle 7

The form al ratifications of this C onvention shall be com m unicated to the D irecto r-G en eral of the In tern atio n al L ab o u r Office for registration.

A rticle 8

1. This C onvention shall be binding only upon those M em bers o f the In te rn a ­ tional L ab o u r O rganisation w hose ratifications havé b een registered with the D irecto r-G en eral.

2. It shall com e into force twelve m onths a fte r the date on which the ratifica­ tions o f tw o M em bers havé been registered with the D irecto r-G en eral.

3. T h ereafter. this C onvention shall com e into force for any M em b er twelve m onths after the date on which its ratification has been registered.

A rticle 9

1. A M em b er which has ratified this C onvention may d enounce it a fte r the ex p iratio n o f ten years from the date o n which the C onvention first com es into force, by an act com m unicated to the D irecto r-G en eral o f the In tern atio n al L ab o u r Office for registration. Such den u n ciatio n shall not lake effect until one y ear a fte r the d ate on which it is registered. 2. E ach M em b er which has ratified this C onvention and which does not. w ithin the year following the expiration o f the p eriod o f ten years m entioned in the preceding p arag rap h , exercise the right o f d enunciation provided for in this A rticle, will be b o und for a n o th e r p eriod o f ten years a n d . th ereafter, may d en o u n ce this C onvention at the ex p iratio n o f each p eriod o f ten years u n d er the term s provided for in this A rticle.

Article 10 1. T h e D irecto r-G en eral o f the In tern atio n al L ab o u r Office shall notify all M em bers o f the In tern atio n al L ab o u r O rganisation o f the reg istratio n o f all ratifications and denunciations co m m u n icated "to him by the M em bers of the O rganisation.

2. W hen notifying the M em bers o f the O rganisation o f the registration o f the second ratification com m unicated to hirn. the D irecto r-G en eral shall draw the atten tio n o f the M em bers o f the O rg an isatio n to the d ate upon which the C o n v en ­ tion will com e into force.

T he D irecto r-G en eral o f the In tern atio n al L ab o u r Office shall com m unicate to the S ecretary -G en eral o f the U n ited N ations fo r registration in accordance with A rticle 102 o f the C h a rte r o f the U n ited N ations full particulars o f all ratifications and acts o f d e n u n d a tio n registered by him in accordance with the provisions o f the the preceding A rticles.

Article 12

A t such tim es as it may consider necessary the G overning Body o f the In tern atio n al L ab o u r Office shall p resen t to the G en eral C onference a re p o rt on the w orking o f this C onvention and shall exam ine the desirability o f placing on the agenda o f the C onference the question o f its revision in w hole o r in p art.

Article 13 1. Should the C onference adopt a new C onvention revising this C onvention in w hole o r in p a rt, th en , unless the new C onvention otherw ise provides -

(a) the ratification by a M em ber of the new revising C onv en tio n shall ipso jure involve the im m ediate denunciation o f this C o nvention, notw ithstanding the provisions o f A rticle 9 above, if and w hen the new revising C onvention shall havé com e in to fo rc e ; (b) as from the date w hen the new revising C onvention com es into force this C onvention shall cease to be open to ratification by the M em bers.

2. This C onvention shall in any case rem ain in force in its actual form and co n ten t for those M em bers which havé ratified it b ut havé not ratified the revising C onvention.
