T he G en eral C onference o f the In tern atio n al L ab o u r O rganisation, Having been convened at G en ev a by the G overning Body o f the In tern atio n al L ab o u r Office, and having m et in its Seventy-fourth Session on 24 S eptem ­ ber 1987, and N öting the provisions of the M edical E xam ination (S eafarers) C o nvention, 1946, the A ccom m odation of C rew s C onvention (R evised), 1949, the Accom m odation o f Crew s (S upplem entary Provisions) C o nvention, 1970, the Ships’ M edicine C hests R eco m m en d atio n , 1958, the M edical A dvice at Sea R ecom m endation, 1958, and the P revention o f A ccidents (S eafarers) C o n ­ vention and R ecom m endation, 1970, and

N öting the term s o f the In tern atio n al C onvention on S tandards o f Training, C ertification and W atchkeeping for S eafarers, 1978, as regards training in m edical aid in the case o f accidents o r illnesses th at are likely to occur on board ship, and N öting th at for the success o f action in the field o f health pro tectio n and m edical care for seafarers, it is im p o rtan t th at d o s e co -operation be m aintained in their respective fields betw een the In tern atio n al L ab o u r O rganis­ a tio n , the In tern atio n al M aritim e O rganization and the World H ealth O rganization, and N öting that the follow ing stan d ard s havé accordingly been fram ed with the co ­ o p e ratio n of the In tern atio n al M aritim e O rganization and the W orld H ealth O rganization, and that it is p roposed to seek th eir continuing co-operation in the application o f these stan d ard s, and H aving decided up cn the ad option o f certain proposals with regard to health p ro tectio n and m edical care for seafarers, which is the fo u rth item on the agenda o f the session, and Having d eterm in ed that these proposals shall take the form o f an in ternational C o nvention, adopts this eighth day o f O cto b er o f the year o n e th o u san d nine h u n d red and eighty-seven the following C onvention which may be cited as the H ealth P rotec­ tion and M edical C are (S eafarers) C o nvention, 1987:

Article 1 1. T his C onvention applies to every seagoing ship w h eth er publicly o r privately ow ned, which is registered in the territo ry o f any M em b er fo r which the C onvention is in force and which is ordinarily engaged in com m ercial m aritim e navigation.

2. To the extent it deem s practicable. a fte r co nsultation with the re p re se n ta ­ tive organisations o f fishing-vessel ow ners and fisherm en, the co m p eten t au thority shall apply the provisions o f this C onvention to com m ercial m aritim e fishing.

3. In the event o f d o ubt as to w h eth er o r not any ships are to be regarded as engaged in com m ercial m aritim e navigation o r com m ercial m aritim e fishing fo r the purpose o f this C o nvention, the question shall be d eterm in ed by the com petent au th o rity after consultation with the organisations o f shipow ners, seafarers and fisherm en co n cem ed .

4. F or the purpose o f this C onvention the term “ se a fa re r" m eans any person who is em ployed in any capacity on b o ard a seagoing ship to which this C onvention applies.

E ffect shall be given to this C o n v en tio n by n ational laws o r regulations, collective ag reem en ts, w orks rules, a rb itratio n aw ards o r co u rt decisions o r o th e r m eans ap p ro p ria te to national conditions.

A r tid e 3

E ach M em b er shall by n ational law s o r regulations m ake shipow ners responsible for keep in g ships in p ro p e r sanitary and hygienic conditions.

A r tid e 4

E ach M em b er shall ensure th at m easures providing for h ealth p ro tectio n and m edical care for seafarers o n b o a rd ship are a d o p te d w h ich -

(a) en su re the application to seafarers o f any general provisions on occupational h ealth p ro tectio n and m edical care relev an t to the seafaring profession, as well as o f special provisions p eculiar to w ork o n b o a r d ; (b) aim at providing seafarers with h e alth p ro tectio n and m edical care as com parable as possible to th at w hich is generally available to w orkers a s h o r e ;

(c) g u a ran tee seafarers the right to visit a d o c to r w ithout delay in po rts o f call w here p ra c tic a b ie ; (d) en su re th a t, in accordance w ith n ational law and practice, m edical care and health p ro tectio n while a sea fa re r is serving o n articles are p ro v id ed free o f charge to s e a fa re rs ; (e) are n o t lim ited to trea tm e n t o f sick o r in ju red seafarers b u t include m easures of a prev en tiv e ch aracter, and dev o te p articu lar atte n tio n to the dev elo p m en t of h ealth p ro m o tio n and h ealth ed u catio n p rogram m es in o rd e r th at seafarers them selves m ay play an active p a rt in reducing the incidence o f ill-health am ong th eir num ber.

A r tid e 5

1. E very ship to which this C o n v en tio n applies shall be re q u ire d to carry a m edicine chest.

2. T h e c o n ten ts o f the m edicine chest an d the m edical eq u ip m en t c arried on b o a rd shall b e prescribed by the co m p e ten t au th o rity taking in to account such factors as the type o f ship, the n u m b er o f persons on b o a rd and the n atu re, destin atio n an d d u ratio n o f voyages. 3. In ad o p tin g o r review ing th e n atio n al provisions concerning th e co n ten ts of the m edicine chest and the m edical e q u ip m e n t carried o n b o a rd , the co m p eten t au th o rity shall tak e in to account in te rn atio n al reco m m en d atio n s in this h eld , such as the m o st recen t ed itio n o f the International M edical G uide fo r S hips and the L ist o f Essential D rugs published by the W orld H ealth O rg an izatio n , as well as advances in m edical know ledge an d a p p ro v ed m eth o d s o f trea tm e n t.

4. T h e m edicine chest and its co n te n ts as well as the m edical eq u ip m en t carried on b o a rd shall be properly m ain tain ed and inspected at reg u lar intervals, not exceeding 12 m o n th s, by responsible p erso n s desig n ated by the co m p eten t a u th o rity , w ho shall ensure th at the expiry d ates an d conditions o f storage o f all m edicines are checked.

5. T h e c o m p eten t au th o rity shall en su re th at the c o n ten ts o f the m edicine chest are listed and labelled with generic nam es in add itio n to any b ra n d nam es used, expiry d ates and conditions o f sto rag e, and th at they conform to the m edical guide used nationally. 6. T h e c o m p e ten t au th o rity shall en su re th at w here a cargo w hich is classified d an g ero u s has n o t b een included in the m ost recen t ed itio n o f the M edical First

A id G uide fo r Use in A ccidenis involving Dangerous G oods published by the In tern atio n al M aritim e O rganization. the necessary inform ation on the n atu re of the substances, the risks involved, the necessary personal protective devices, the relevant m edical pro ced u res and specific a n tid o tes is m ade available to the master, seafarers and o th e r in terested persons. Such specific an tid o tes and personal p ro ­ tective devices shall be on b oard w henever d an g ero u s goods are carried.

7. In cases of urgent necessity and w hen a m edicine prescribed by qualified m edical personne! for a seafarer is not available in the m edicine chest, the shipow ner shall take all necessary steps to o btain it as soon as possible.

A rticle 6 1. E very ship to which this C onvention applies shall be req u ired to carry a s h ip s m edical guide a d o p te d by the co m p eten t authority.

2. T he m edical guide shall explain how the co n ten ts o f the m edicine chest are to be used and shall be designed to enable persons o th er th ån a d o cto r to care for the sick o r injured o n b oard b o th with and w ithout m edical advice by radio or satellite com m unication. 3. In ad opting o r review ing the ship s m edical guide used nationally, the co m p eten t au th o rity shall take into account in tern atio n al reco m m en d atio n s in this field, including the m ost recent edition o f the International M edical G uide fo r Ships and the M edical First A id G uide fo r Use in A ccidents involving D angerous G oods. A rticle 7 1. T he co m p eten t authority shall ensure by a p rearran g ed system th at m edical advice by rad io o r satellite com m unication to ships at sea, including specialist advice, is available at any h o u r o f the day o r night.

2. Such m edical advice, including the on w ard transm ission of m edical messages by rad io o r satellite com m unication betw een a ship and those ashore giving the advice, shall be available free o f charge to all ships irrespective o f the tern to ry in which they are registered. 3. W ith a view to ensuring th at optim um use is m ade o f facilities available for m edical advice by rad io o r satellite co m m u n icatio n - (a) all ships to which this C onvention applies which are eq u ip p ed with radio installations shall carry a com plete list o f radio stations thro u g h which m edical advice can be o b ta in e d ;

(b) all ships to which this C onvention applies which are eq u ip p ed with a system of satellite com m unication shall carry a com plete list o f coast e arth stations thro u g h which m edical advice can be o b ta in e d ;

(c) the lists shall be kept up to date and in the custody of the person on board responsible for com m unication duties. 4. S eafarers on b o ard requesting m edical advice by radio o r satellite com m uni­ cation shall be instructed in the use o f the ship's m edical guide and the m edical section o f the m ost recent edition o f the International C ode o f Signals published by the In tern a tio n a l M aritim e O rganization so as to en ab le them to u n d e rstan d the type o f inform ation needed by the advising d o c to r as well as th e advice received.

5. T he co m p eten t au th o rity shall ensure that doetors providing m edical advice in accordance with this A rticle receive ap p ro p riate training and are aw are of shipboard conditions.

A rticle 8

1. A ll ships to which this C onvention applies carrying 100 o r m ore seafarers and o rdinarily engaged on in tern atio n al voyages o f m ore th ån th ree d ay s’ d u ratio n

shall carry a m edical d octor as a m em b er of the crew responsible for providing m edical care.

2. N ational laws o r regulations shall d eterm in e which o th e r ships shall be req u ired to carry a m edical d octor as a m em b er of the crew . taking in to account. in ter alia. such factors as the d u ra tio n , n a tu re and conditions o f the voyage and the n u m b er o f seafarers on board.

A r tid e 9

1. A ll ships to which this C o nvention applies and which do n ot carry a d octor shall carry as m em bers of the crew one o r m ore specified persons in charge of m edical care and the adm inistering of m edicines as p art o f th eir reg u lar duties.

2. P ersons in charge of m edical care o n b o ard who are not doetors shall havé satisfactorily com pleted a course a p p ro v ed by the co m p eten t au th o rity o f th eo retical and applied training in m edical skills. This course shall c o m p rise-

(a) för ships o f less th ån 1,600 gross to n n ag e w hich ordinarily are capable of reaching qualified m edical care and m edical facilities w ithin eight hours, e lem en tary training which will en ab le such persons to tak e im m ediate, effective action in case o f accidents o r itlnesses likely to occur on b o ard ship and to m ake use of m edical advice by radio o r satellite c o m m u n ica tio n ;

(b) for all o th er ships. m ore advanced m edical training, including practical training in the em ergency/casualty d e p artm e n t of a hospital w here practicable and training in life-saving techniques such as intravenous th erap y , which will en ab le the persons c o n cem ed to particip ate effectively in co -o rd in ated schem es för m edical assistance to ships at sea, and to provide the sick o r injured with a satisfactory stan d ard o f m edical care d uring the p erio d they are likely to rem ain on board. W h erev er possible, this training shall be provided u n d er the supervision o f a physician with a th orough know ledge and understanding o f the m edical problem s and circum stances relating to the seafaring profession, including expert know ledge o f rad io o r satellite com m unication m edical services.

3. T he courses referred to in this A rticle shall be based o n the co n ten ts o f the m ost recen t edition o f the International M edical G uide fo r Ships, the M edical First A id G uide fo r Use in A ccidents involving Dangerous G oo d s, the D ocum ent fo r G uidance ■ A n International M aritim e Training G uide published by the In te rn a ­ tional M aritim e O rg an izatio n . and the m edical section o f the International C ode o f Signals as well as sim ilar national guides.

4. P ersons re fe rre d to in p arag rap h 2 o f this A rticle and such o th e r seafarers as may be req u ired by the co m p eten t au th o rity shall und erg o refresh er courses to enable them to m aintain and increase th eir know ledge and skills and to keep ab reast o f new d evelopm ents, at approxim ately five-year intervals.

5. A ll seafarers, during their m aritim e vocational training, shall receive instruetion on the im m ediate action th a t should be tak en on en co u n terin g an accident o r o th e r m edical em ergency on b o ard .

6. In add itio n to the person o r persons in charge of m edical care on b o ard , a specified crew m em b er o r crew m em b ers shall receive elem en tary training in m edical care to enable him o r them to tak e im m ediate effective action in case of accidents o r illnesses likely to occur on b o ard ship.

A rticle 10 A ll ships to which this C onv en tio n applies shall provide all possible m edical assistance, w here practicable, to o th e r vessels w hich may req u est it.

1. In any ship o f *'00 o r m ore gross to n n ag e, carrying 15 o r m o re seafarers and engaged in a voyage o f m ore th ån th ree d ay s’ d u ra tio n , se p a ra te h ospital accomm odation shall be provided. T he co m p eten t au th o rity m ay relax this req u irem en t in respect o f ships engaged in coastal trade.

2. In any ship o f betw een 200 an d 500 gross tonnage and in tugs this A rticle shall be applied w here reaso n ab le and practicable. 3. T his A rticle does not apply to ships prim arily p ro p elled by sail.

4. T he hospital accom m odation shall be suitably situ ated . so th at it is easy of access and so th at the occupants m ay be com fortably h oused and may receive p ro p e r a tte n tio n in all w eathers. 5. T he hospital accom m odation shall be so designed as to facilitate co n su lta­ tion and the giving o f m edical first aid. 6. The arran g em en t o f the e n tra n ce , b e rth s, lighting, ven tilatio n , h eating and w ater supply shall be designed to ensure the com fort an d facilitate the trea tm e n t o f the occupants. 7. T he n u m b er o f hospital b erth s req u ire d shall be prescrib ed by the com pe­ ten t authority. 8. W ater closet accom m odation shall be prov id ed fo r the exclusive use o f the o ccupants o f the hospital accom m odation, e ith e r as p a rt o f the accom m odation o r in d o s e proxim ity th ere to . 9. H ospital accom m odation shall n ot be used for o th er th ån m edical purposes.

A r tid e 12 1. A sta n d ard m edical re p o rt form for seafarers shall be a d o p te d by the c o m p eten t au th o rity as a m odel for use by sh ip s’ d o eto rs, m asters o r persons in charge o f m edical care on b o ard a n d hospitals o r doetors ashore. 2. T he form shall be sp e d a lly designed to facilitate the exchange o f m edical and re lated inform ation con cem in g individual seafarers b etw een ship and shore in cases o f illness o r injury. 3. T he inform ation co n tain ed in the m edical re p o rt form shall be k ep t confid en tial and shall be used för no o th e r pu rp o se th ån to fa d lita te the trea tm e n t o f seafarers.

A r tid e 13 1. M em bers for which this C onv en tio n is in force shall co -o p erate with one a n o th e r in pro m o tin g p ro tectio n o f the h ealth o f seafarers and m edical care for th em on b o a rd ship. 2. Such co -o p eratio n m ight cover the follow ing m a tte r s : (a) developing and co-ordinating search and rescue efforts and arranging pro m p t m edical help an d evacuation at sea for the seriously ill o r injured on b o a rd a ship thro u g h such m eans as periodic ship position rep o rtin g system s, rescue coo rd in atio n c en tres and em ergency h elico p ter services, in conform ity w ith the provisions o f the In tern a tio n a l C o nvention o f M aritim e Search and R escue, 1979, and the M erchan! Ship Search and R escue M anual and IM O Search and R escue M anual d ev elo p ed by the In tern a tio n a l M aritim e O rg a n iz a tio n ;

(b) m aking optim um use o f fishing vessels c an y in g a d o cto r and stationing ships at sea which can provide hospital and rescue fa cilitie s;

(c) com piling and m aintaining an in tern atio n al list o f d oetors and m edical care facilities available world-w ide to provide em ergency m edical care to s e a fa re rs ;

(d) landing seafarers in p o rt fo r em ergency tr e a tm e n t; (e) re p atriatin g seafarers h ospitalised a b ro ad as soon as practicab le, in accordance with th e m edical advice o f the d o eto rs responsible för the case. which takes into account the se a fa re r's wishes and n e e d s ; (f) arranging personal assistance for seafarers during rep atria tio n , in accordance with the m edical advice o f the d o eto rs responsible for the case, which takes in to account the seafareris wishes and n e e d s ; fg) e n d eav o u rin g to set up h e alth c en tres for seafarers to -

(i) co n d u ct research o n the h ealth statu s, m edical trea tm e n t and preventive h ealth care o f se a fa re rs; (ii) train m edical and h ealth service staff in m aritim e m e d ic in e ;

(h) collecting and evaluating statistics con cem in g o ccupational accidents, diseases and fatalities to seafarers and integ ratin g and harm onising th em with any existing n ational system o f statistics on o ccupational accidents, diseases and fatalities covering o th er categories o f w o rk e rs ;

(i) organising intern atio n al exchanges o f technical in form ation, train in g m aterial an d p erso n n el, as well as in te rn atio n al training courses, sem inars and working g ro u p s ; (j) providing all seafarers with special curative and preventive h ealth and m edical services in p o rt, o r m aking available to th em general h e alth , m edical and reh ab ilitatio n se rv ice s;

(k) arranging för the rep atriatio n o f the bodies o r ashes, in accordance with the w ishes o f the next o f kin. o f deceased seafarers as soon as practicable.

3. In tern a tio n a l co -o p eratio n in the held o f h ealth p ro tectio n and m edical care fö r seafarers shall be based on bilateral o r m ultilateral ag reem en ts o r consultations am ong M em bers.

A rticle 14 T h e form al ratiheations o f this C o n v en tio n shall be com m u n icated to the D ire cto r-G e n era l o f the In tern atio n al L ab o u r Office for registration.

A r tid e 15

1. T his C o nvention shall be binding only up o n those M em bers o f the In te rn a ­ tional L ab o u r O rganisation w hose ratih eatio n s havé b een registered with D irector- G en eral.

2. It shall com e into force twelve m onths a fte r the dale o n which the ratih ea­ tions o f tw o M em bers havé been reg istered w ith the D ire cto r-G e n era l. 3. T h ereafter. this C o nvention shall com e into force for any M em b er twelve m o n th s a fte r the date on which its ratih eatio n has b een registered.

A r tid e 16

1. A M em b er which has ra tih ed this C onv en tio n may d en o u n ce it a fte r the ex p iratio n o f ten years from the date o n which the C o n v en tio n hrst com es into force, by an act com m unicated to the D irecto r-G en eral of the In tern atio n al L ab o u r O fhce for registration. Such d en u n ciatio n shall not tak e effect until one year a fte r the date o n which it is registered.

2. E ach M em b er which has ratified this C onv en tio n and w hich does not. w ithin the year follow ing the ex p iratio n o f the p eriod o f ten years m en tio n ed in the

preceding p arag rap h , exercise the right o f denunciation provided for in this A r tid e , will be b ound for a n o th e r p eriod of ten years an d , tb ereafter, may denounce this C onvention at the expiration of each period o f ten years u n d er the term s provided for in this A rtid e .

Article 17 1. T he D irecto r-G en eral o f the In tern atio n al L ab o u r Office shall notify all M em bers o f the In tern atio n al L ab o u r O rganisation o f the registration o f all ratifications and ^denunciations com m unicated to him by the M em bers o f the O rganisation. 2. W hen notifying the M em bers o f the O rganisation o f the registration o f the second ratification com m unicated to him . the D irecto r-G en eral shall draw the atten tio n o f the M em bers o f the O rganisation to the date upon which the C onven­ tion will com e into force. Article 18

T he D irecto r-G en eral of the In tern atio n al L ab o u r Office shall com m unicate to the S ecretary-G eneral of the U n ited N ations for registration in accordance with A rticle 102 o f the C h a rte r of the U nited N ations full particulars o f all ratifications and acts o f d enunciation registered by him in accordance with the provisions o f the preceding A rtid e s .

Article 19

A t such tim es as it may consider necessary the G o v em in g B ody o f the In tern atio n al L ab o u r Office shall p resen t to the G en eral C onference a rep o rt on the w orking o f this C onvention and shall exam ine the desirability o f p la d n g on the agenda o f the C onference the question of its revision in w hole o r in p art.

A rticle 20 1. Should the C onference adopt a new C onvention revising this C onvention in w hole o r in p a rt. th en , unless the new C onvention otherw ise p ro v id es-

(a) the ratification by a M em ber o f the new revising C onvention shall ipso jure involve the im m ediate d enunciation o f this C o nvention, notw ithstanding the provisions o f A rticle 16 above, if and w hen the new revising C onvention shall havé com e into fo rce; (b) as from the date w hen the new revising C o nvention com es into force this C onvention shall cease to be o p en to ratification by the M em bers.

2. This C onvention shall in any case rem ain in force in its actual form and co n ten t fö r those M em bers which havé ratified it b u t havé n ot ratified the revising C onvention. A rticle 21
