fortsätter att gälla i förhållande till Slovenien

Vid underh an d sk o n tak ter m ellan Sverige och Slovenien har en genom ­ gång gjorts av överenskom m elserna m ellan Sverige och f.d. Socialistiska federativa republiken Jugoslavien. Sloveniens u trikesm inisterium har i note den 7 april 1993 inform erat om de avtal som m an på slovensk sida anser gäller mellan Sverige och Slovenien sam t hem ställt om den svenska uppfattningen i frågan. Regeringen anslöt sig den 29 april 1993 till den gjorda bedöm ningen och beslutade att de båda noterna skall offenliggöras i Sveriges internationella överenskom m elser (SÖ). Sveriges svarsnote är daterad den 3 maj 1993.

T he M inistry for Foreign Affairs o f th e R epublic o f Slovenia presents its com plim ents to th e M inistry for Foreign Affairs o f th e K ingdom o f Swe­ den and has the hon o u r to convey th e following: The Republic o f Slovenia has becom e an In dependent State, w hich has already acknowledged (Article 3 o f the C on stitu tio n al Law o f Ju n e 25, 1991) th a t Treaty Rights and O bligations o f th e form er SFR o f Yugoslavia would be inherited by Slovenia on its territory by v irtue o f th e C ustom ary International Law. Since it is likely th at certain treaties m ay havé lapsed at the date o f Independence o f Slovenia o r there is interest to renew, changé o r substitute them w ith new ones, it seem s essential th a t each treaty should be subjected to legal exam ination. The M inistry for Foreign Affairs o f the R epublic o f Slovenia has studied the bilateral agreem ents concluded betw een the form er SFR o f Yugoslavia and the K ingdom o f Sweden. T he M inistry should like to notify th e M inistry for Foreign Affairs o f the K ingdom o f Sweden th a t th e G overn­ m ent o f th e R epublic o f Slovenia has com e to th e conclusion th a t the agreem ents w hich are listed below rem ain in force betw een th e R epublic o f Slovenia and the Kingdom o f Sweden. 1. C onvention between the SFR o f Y ugoslavia and th e K ingdom o f Sweden on social security, with Protocol to th e C onvention and th e Agreem ent on im plem entation o f the A greem ent, signed at Stockholm on M arch 30, 1978. 2. Agreem ent between th e G overnm ent o f the SFR o f Y ugoslavia and the G overnm ent o f the K ingdom o f Sweden on the m utual p rotection o f investm ents, signed at Belgrade on N ovem ber 10, 1978. 3. C onvention between the SFR o f Yugoslavia an d th e K ingdom o f Sweden for the avoidance o f double taxation w ith respect to taxes on incom e and capital, with Protocol, signed at Stockholm on Ju n e 18, 1980. If the G overnm ent o f th e K ingdom o f Sweden has arrived at the sam e conclusion, th e M inistry suggests th at th e present note an d th e affirm ative reply by the M inistry for Foreign Affairs o f th e K ingdom o f Sweden, co nstitute a jo in t confirm ation th at the afore-m entioned agreem ents re­ m ain in force between the R epublic o f Slovenia and the K ingdom o f Sweden. The M inistry for Foreign Affairs o f the R epublic o f Slovenia avails itself o f this o p p o rtunity to renew to the M inistry för Foreign Affairs o f the Kingdom o f Sweden the assurances o f its highest consideration.

SFR Jugoslaviens trak taträttig h eter och -förpliktelser skall övertas av Slovenien på dess te rrito riu m m ed stöd av internationell sedvanerätt. E ftersom det är troligt ^ t t vissa avtal kan ha u p phört a tt gälla vid dagen för Sloveniens självstän­ dighet eller det finns intresse a tt förnya, än d ra eller ersä tta dem m ed nya, tycks det vara väsentligt att varje avtal undergår en ju rid isk granskning. R epubliken Sloveniens u trikesm inisterium h ar stu d erat de bilaterala överenskom m elser som har ingåtts m ellan f.d. SFR Jugoslavien och Ko­ nungariket Sverige. M inisteriet vill u n d errätta K onungariket Sveriges utrikesdepartem ent om a tt R epubliken Sloveniens regering h ar k om m it till den slutsatsen att de överenskom m elser som är upptagna på n edanstående lista fo rtsätter a tt gälla m ellan R epubliken Slovenien och K onungariket Sverige. 1. K onvention m ellan SFR Jugoslavien och K onungariket Sverige rö­ rande social trygghet jä m te protokoll och tilläm pningsöverenskom m else, undertecknad i Stockholm den 30 m ars 1978, 2. Ö verenskom m else m ellan S FR Jugoslaviens regering och K onungari­ ket Sveriges regering om öm sesidigt skydd av investeringar, undertecknad i Belgrad den 10 novem ber 1978, 3. K onvention m ellan SFR Jugoslavien och K onungariket Sverige för att undvika dubbelbeskattning beträffande sk atter på inkom st och förm ögen­ het jä m te protokoll, undertecknad i Stockholm den 18 ju n i 1980. O m K onungariket Sveriges regering h ar kom m it till sam m a slutsats, föreslår m inisteriet a tt den n a note jä m te K onungariket Sveriges utrikesde­ partem en ts bekräftande svar skall utgöra en gem ensam bekräftelse på att fö ru tn äm n d a överenskom m elser fo rtsätter a tt gälla m ellan R epubliken Slovenien och K onungariket Sverige.
