fixing the monetary compensatory amounts and certain coefficients and rates required for their application

THE COMMISSION OF THE EUROPEAN — the ratio between the conversion rate used for the COMMUNITIES , purposes of the common agricultural policy for the currency of the relevant Member State and the actual parity of each of the currencies of the Having regard to the Treaty establishing the Member States which keep their exchange rates at European Economic Community, any given moment within a maximum spread of 2,25 % , and Having regard to Council Regulation (EEC) No 974 / 71 of 12 May 1971 on certain measures of — the spot market rate recorded over a given period conjunctural policy to be taken in agriculture for the currency of the relevant Member State following the temporary widening of the margins of against each of the currencies of the Member fluctuation for the currencies of certain Member States which keep their exchange rates at any given moment within a maximum spread of States (!), as last amended by Regulation (EEC) No 2,25 % ; 3439 / 82 (2), and in particular Article 6 thereof,

Whereas , however, this average must be reduced by Having regard to Council Regulation (EEC) No 1,5 points in the case of negative monetary 1223 / 83 of 20 May 1983 on the exchange rates to be compensatory amounts and by one point in the case applied in agriculture (3), of positive monetary compensatory amounts ;

Having regard to Commission Regulation (EEC) No Whereas, however, pursuant to Article 2 ( la) (b) of 1516 /78 of 30 June 1978 on the obligatory Regulation (EEC) No 974/71 , the percentage of 1 adjustments to be made to monetary compensatory shall be applied as long as, after deduction of the amounts fixed in advance and repealing Regulation franchises referred to in the same paragraph, the (EEC) No 651 / 78 (4), and in particular Article 1 (2) result obtained is less than 1,1 and greater than 0 ; thereof, Whereas , under Article 2 (4) of Regulation (EEC) Whereas, by virtue of Article 2 ( 1 ) (a) of Regulation No 974/71 , the monetary compensatory amount to be applied in the wine sector by Member States with (EEC) No 974/71 , the monetary compensatory amounts for the currencies of the Member States depreciating currencies should be that of the Member State in question for the wine concerned less the which keep their exchange rates at any given moment lowest monetary compensatory amount of the within a maximum spread of 2,25 % are equal to the Member States with depreciated currencies for the amounts obtained by applying to the prices the same wine ; percentage representing the difference between :

— Germany : Whereas Article 2a of Regulation (EEC) No 974/71 is not for the moment being applied ; milk and milk products sector and derived products to which Regulation Whereas Article 7 ( 1 ) of Commission Regulation (EEC) No 3033/ 80 applies : + 10,8 (EEC) No 1160/ 82 of 14 May 1982 providing for the beef and veal sector : + 9,8 advanced fixing of monetary compensatory other sectors : 4- 11,9 amounts (J) provides that the compensatory amounts fixed in advance must be adjusted if a new repre — France : sentative rate comes into effect during the period of milk and milk products sector and validity of the certificate ; whereas this new rate must derived products to which Regulation have been decided before the application for the cer (EEC) No 3033 / 80 applies : — 3,4 tificate was lodged ; whereas this situation has arisen beef and veal sector : — 4,4 in some sectors for Germany, France, Greece, Ireland, Italy and the Netherlands ; pigmeat sector : — 2,2 wine sector : — 6,4 Whereas the monetary compensatory amounts other sectors : — 9,5 introduced by Regulation (EEC) No 974/71 were fixed by Regulation (EEC) No 689/83 (4), as last — Ireland : amended by Regulation (EEC) No 1108 / 83 0 ; all sectors : 0 whereas it should be replaced by a new Regulation ;

— Netherlands : Whereas the monetary compensatory amounts for milk and milk products sector and products falling within Common Customs Tariff derived products to which Regulation heading No 04.01 with the exception of acidified milk (EEC) No 3033 / 80 applies : + 6,6 should henceforth be calculated on the basis of the buying-in prices for butter and milk powder, less all beef and veal sector : -I- 5,8 the buying-in costs ; other sectors : + 7,3 ; Whereas the measures provided for in this Regulation Whereas, as regards the pound sterling, the Italian are in accordance with the opinion of all the relevant lira and the Greek drachma, the monetary management committees, compensatory amounts to which the provisions of Article 2 ( 1 ) of Commission Regulation (EEC) No 1372/ 81 of 19 May 1981 laying down detailed rules HAS ADOPTED THIS REGULATION : for the calculation of monetary compensatory amounts ('), as amended by Regulation (EEC) No Article 1 386/ 82 (2), normally apply, should be calculated on the basis of the rates during the reference period The monetary compensatory amounts referred to in Wednesday, 11 May to Tuesday , 17 May 1983 ; Article 1 of Regulation (EEC) No 974/71 are fixed whereas these provisions give monetary compensatory for the Member States concerned in Annex I. amounts of :

— Italy : Article 2 all sectors : 0 The coefficients referred to in Article 5 (4) of Regu — United Kingdom : lation (EEC) No 1372/ 81 are fixed in Annex II. all sectors : + 3,5

Article 6 (EEC) No 1160/ 82 to monetary compensatory amounts fixed in advance are shown in Annexes IV This Regulation shall enter into force on the day of and IVa hereto . its publication in the Official Journal of the European Article 5 Communities.

Regulation (EEC) No 689/ 83 is hereby repealed . It shall be applicable from 23 May 1983 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .

(') The monetary compensatory amount shall apply to products whose starch content is not less than 85 % by weight. For products with a starch content lower than 85 % by weight, this compensatory amount shall be multiplied by a coefficient calculated by means of the following formula : a C = X 1,1 / 6 1 000 (C = coefficient ; a = content by weight of starch, expressed as dry matter, per 1 000 kg of the product). When completing the customs formalities, the applicant must state in the declaration provided for this purpose the content by weight of starch , expressed as dry matter, per 1 000 kg of the product.

(') The monetary compensatory amount shall apply to the product whose starch content is not less than 78 % by weight. For the product with a starch content lower than 78 % by weight, this compensatory amount shall be multiplied by a coefficient calculated by means of the following formula : a C - x 1,282 1 000 (C = coefficient; a = content by weight of starch, expressed as dry matter, per 1 000 kg of the product). When completing the customs formalities, the applicant must state in the declaration provided for this purpose the content by weight of starch, expressed as dry matter, per 1 000 kg of the product.

7) Pursuant to Regulation (EEC) No 2730 /75 , the product falling within subheading 17.02 B I is subject to the same compensa tory amount as products falling within subheading 17.02 B II.

(') If the product contains powdered or granulated milk (excluding whey), the amount shown shall be increased by the following supplementary amount :

(a) In trade with non-member countries, the coefficient 1,74 shall be applied to the supplementary amounts indicated above.

(b) In intra-Community trade and trade with non-member countries the additional amounts specified above shall, if the products contain skimmed-milk powder purchased under the conditions laid down in Regulations (EEC) No 368 /77 (OJ No L 52 , 24. 2. 1977) and (EEC) No 443 /77 (OJ No L 58 , 3 . 3 . 1977) and more than 9,0 grams of iron and/or more than 1,2 grams of copper per 100 kilograms, be multiplied by the coefficient 0,25 . However, the coefficient 0,53 which applied to those products up to 19 December 1982 shall, at the request of the trader, continue to apply to quantities in respect of which evidence is provided that the skimmed-milk powder was purchased before 3 November 1982. The above provisions shall apply to trade carried on by 31 December 1983 where these products contain fish meal.

(c) When completing customs formalities the party concerned shall state in the declaration provided for this purpose the content, expressed in actual weight per tonne of finished product, of :

— powdered or granulated milk (excluding whey), — powdered or granulated whey, — added casein or caseinate .

(') In the case of products containing products falling within heading No 07.06 or subheading 11.04 C of the Common Customs Tariff, no monetary compensatory amount shall be granted on the cereal constituent. However, the amounts indicated shall apply if compensatory amounts are due to be levied.

(') For skimmed-milk powder consigned to Italy from another Member State in accordance with Regulation (EEC) No 1624/76 (OJ No L 180 , 6. 7 . 1976) the amount indicated shall be multiplied by the coefficient 0,58 . In intra-Community trade with skimmed-milk powder in unaltered state, sold under Regulation (EEC) No 368/77 (OJ No L 52 , 24 . 2. 1977) or Regulation (EEC) No 443 /77 (OJ No L 58 , 3 . 3 . 1977), the amount indicated shall be multiplied by the coefficient 0,14. However, the coefficient 0,30 shall continue to apply, on application by dealers, in respect of quantities of products for which evidence is produced that the skimmed-milk powder was bought before 3 November 1982 .

(*) In intra-Community trade, where the product has been denatured in accordance with Article 3 of Regulation (EEC) No 1725 /79 (OJ No L 199, 7. 8 . 1979), the basic amount and any additional amount shall be replaced by a single amount of:

— DM 24,07 per 1 00 kg for the Federal Republic of Germany, — F1 15,81 per 100 kg for the Netherlands, — Dkr 7,22 per 100 kg for Denmark, — £ 1,898 per 100 kg for the United Kingdom, — FF 19,53 per 100 kg for France .

(s) The basic amount for 100 kg of product falling within this subheading shall be equal to the sum of the following components :

(a) the amount per 100 kg indicated multiplied by 1/100 of the weight of the lactic part contained in 100 kg of product. However, where whey and/or lactose have been added to the product, the amount resulting from the preceding calcu lation shall be :

— multiplied by the weight of the lactic non-fat part, other than the added whey and/or added lactose, contained in 100 kg of the product,

and then — divided by the weight of the non-fat lactic pan contained in 100 kg of the product;

(b) an additional amount for each percentage point of sucrose content of 100 kg net of the product, equal to '/ too of the amount indicated in Part 7 of this Annex under subheading 17.01 A (undenatured) of the Common Customs Tariff.

When completing customs formalities , the applicant shall state on the declaration provided for this purpose :

— the actual content by weight of added whey and/or added lactose per 100 kg of finished product,

and, in particular : — the lactose content of the added whey.

4) However, for butter or concentrated butter covered by the measures provided for : — in Regulation (EEC) No 1282/72 (OJ No L 142 , 22 . 6 . 1972), the amount indicated shall be multiplied by the coefficient 0,47 ; — in Regulation (EEC) No 1717 /72 (OJ No L 181 , 9 . 8 . 1972), the amount indicated shall be multiplied by the coefficient 0,47 ; — in Regulation (EEC) No 649/ 78 (OJ No L 86, 1 . 4 . 1978), the amount shall be multiplied by the coefficient 0,47 ;

— in Regulation (EEC) No 262 /79 (OJ No L 41 , 16. 2 . 1979), Regulation (EEC) No 1468 /79 (OJ No L 177, 14 . 7. 1979) and Regulation (EEC) No 1932 / 81 (OJ No L 191 , 14 . 7 . 1981 ), the amount shall be multiplied :

— by the coefficient 0,50 where the butter is to be used in formula A or formula C products,

— by the coefficient 0,69 where the butter is to be used in formula B products.

(') With respect to cheese rinds and wastes the monetary compensatory amount applicable shall be that applicable to products of subheading 04.04 E I c) of a fat- content, by weight, in the dry matter of 10 % or more. Products unfit as such for human consumption shall be regarded as cheese wastes .

4) When completing customs formalities, the party concerned shall state in the declaration provided for this purpose :

— the skimmed-milk powder content, by weight, — the content by weight of the added whey and/or added lactose, and

— the lactose content of the added whey, per 100 kg of the finished product.

In trade with non-member countries , the coefficient 1,74 shall be applied to the supplementary amounts indicated above.

In intra-Community trade and trade with non-member countries the additional amounts specified above shall , if the products contain skimmed-milk powder purchased under the conditions laid down in Regulations (EEC) No 368 / 77 (OJ No L 52 , 24 . 2 . 1977) and (EEC) No 443 /77 (OJ No L 58 , 3 . 3 . 1977) and more than 9,0 grams of iron and/or more than 1,2 grams of copper per 100 kilograms, be multiplied by the coefficient 0,25 . However, the coefficient 0,53 which applied to those products up to 19 December 1982 shall, at the request of the trader, continue to apply to quantities in respect of which evidence is provided that the skimmed-milk powder was purchased before 3 November 1982 . The above provisions shall apply to trade carried on by 31 December 1983 where these products contain fish meal.

In intra-Community trade, where the product has not been produced in accordance with Regulation (EEC) No 1725/79 (OJ No L 199, 7. 8 . 1979), the coefficient 1,74 shall be applied to the supplementary amounts indicated above. However, this coefficient shall not be applied to products consigned to Italy from another Member State in accordance with Regu lation (EEC) No 1624 / 76 (OJ No L 180 , 6 . 7 . 1976).

(') The basic amount for 100 kg of product falling within this subheading shall be equal to the sum of the following components : (a) the amount per 100 kg indicated. However, where whey and/or lactose have been added to the product, the amount indicated shall be :

— multiplied by the weight of the lactic non-fat part, other than the added whey and/or added lactose, contained in 100 kg of the product, and then — divided by the weight of the non-fat lactic part contained in 100 kg of the product ;

(') In the case of products to which whey and/or lactose have been added, no compensatory amount shall be granted. However, the amounts indicated shall apply if compensatory amounts have to be charged.

When completing :

— customs export formalities carried out in a Member State the currency of which has appreciated,

— customs import formalities carried out in a Member State the currency of which has depreciated,

— customs export formalities carried out in a Member State making use of the option provided in Article 2a of Regulation (EEC) No 974/71 ,

the applicant shall state on the declaration provided for this purpose whether or not whey and/or lactose have been added to the product.

10) For cream covered by the measures provided for in Regulation (EEC) No 649/78 (OJ No L 86, 1 . 4. 1978), the monetary compensatory amount shall be multiplied by the coefficient 0,47 .

(") For cheeses manufactured exclusively from sheep or goat milk : — the analysis check shall be carried out by immunological methods such as double immuno-diffusion and radial immuno diffusion, supplemented as necessary by electrophoresis of the caseins, — the party concerned shall be obliged, when completing the customs formalities, to state in the declaration provided for this purpose that the cheese in question was manufactured exclusively from sheep and/or goat milk.

(") No compensatory amount shall be applicable on imported cheeses covered by the provisions of Articles 7 ( 1 ), 9 ( 1 ), 10 and 1 1 of amended Regulation (EEC) No 2915/79, provided that the free-at-frontier value applicable for the cheese in question, if one has been laid down, is respected or that tne import price is not less than the amount specified in Article 11 ( 1 ) of that Regulation for the cheese in question, or on the cheeses specified in Article 1 1 (2) of that Regulation, provided that they are covered by (r) of Annex II to that Regulation if it is established that they correspond to the description given therein.

(") In the case of cheeses presented in containers which also contain conserving liquid, in particular brine, the monetary compensatory amount is granted on the net weight, the weight of the liquid being deducted.
