COUNCIL REGULATION ( EEC ) No 4034 / 86 of 22 December 1986 fixing, for certain fish stocks and groups of fish stocks, the total allowable catches for 1987 and certain conditions under which they may be fished

THE COUNCIL OF THE EUROPEAN COMMUNITIES , Whereas Article 164 of the Act of Accession establishes the activities which may be carried out under certain circumstances by vessels flying the flag of Member States, with the exception of Spain and Portugal , in the waters of Having regard to the Treaty establishing the European the Atlantic Ocean falling under the sovereignty or within Economic Community , the jurisdiction of Spain and covered by the International Council for the Exploration of the Sea (ICES ); Having regard to the Act of Accession of Spain and Portugaland in particular Articles 161 , 164, 165 , 349 and 352 thereof, Whereas Article 165 of the Act of Accession establishes the activities which may be carried out under certain circumstances by vessels flying the flag of Portugal in the Having regard to Council Regulation ( EEC) No 170 / 83 of waters falling under the sovereignty or within the 25 January 1983 establishing a Community system for the conservation and management of fishery resources ('), and jurisdiction of Spain and covered by ICES and the Fishery Committee for the Eastern Central Atlantic ( CECAF ); in particular Article 1 1 thereof,

Having regard to the proposal from the Commission , Whereas Article 349 of the Act of Accession establishes certain fishing possibilities under certain conditions for Whereas , under the terms of Article 2 of Regulation (EEC ) vessels flying the flag of Portugal in the waters falling under No 170 / 83 it is incumbent upon the Council to formulate , the sovereignty or within the jurisdiction of Member States , in the light of the available scientific advice and , in with the exception of Spain and Portugal , and covered by particular, of the report prepared by the Scientific and ICES : Technical Committee for Fisheries , the conservation measures necessary to achieve the aims set out in Article 1 of the same Regulation ; Whereas Article 352 of the Act of Accession establishes the activities which may be carried out under certain Whereas, under the terms of Article 3 of Regulation (EEC) conditions by vessels flying the flag of Spain and listed No 170 / 83 it is incumbent upon the Council to establish and / or registered in a port situated in the territory to the total allowable catches ( TAC) by stock or group of which the Common Fisheries Policy applies in the waters stocks, the share available for the Community and also the falling under the sovereignty or within the jurisdiction of specific conditions under which the catches must be made; Portugal and covered by ICES and CECAF ; whereas , in order to ensure effective management, the TACs available for the Community in 1987 should be fairly allocated among the Member States in accordance Whereas, in conformity with the procedure provided for in with Article 4 of the same Regulation ; Article 2 of the fisheries agreement between the European Economic Community and the Kingdom of Norway ( 2 ), Article 2 of the fisheries agreement between the European Whereas , in order to ensure the protection of fishing Economic Community and the Kingdom of Sweden ( 3 ), grounds and fish stocks and the balanced exploitation of the resources of the sea , in the interests of both fishermen and Article 2 of the fisheries agreement between the European Economic Community and the government of and consumers , there should be fixed, each year for the Denmark and the local government of the Faroe Islands (4 ), different species of which the catches must be restricted, a the parties have consulted on their reciprocal fishing rights TAC per stock or group of stocks and the share of these for 1987 ; catches available to the Community taking into account its commitments to third countries ;

Article 5 3. The determination of the percentage of by-catches and their disposal shall be made in accordance with Article 2 of 1 . It shall be prohibited to retain on board or to land Regulation (EEC) No 3094 / 86 . catches from stocks for which TACs or quotas are fixed unless : Article 6 (i ) the catches have been taken by vessels of a Member State having a quota and that quota is not exhausted , or 1 . Fishing for herring shall be prohibited from 1 July to 31 October 1987 within the area bounded by the following coordinates : (ii) the share of the TAC available to the Community ( Community share) has not been allocated by quota — the west coast of Denmark at 55°30 ' N , among Member States and the Community share has not been exhausted , or — latitude 55°30 ' N, longitude 7°00 ' E , — latitude 57°00' N , longitude 7°00 ' E , ( iii) for all species other than herring and mackerel , they are mixed with other species and have been taken with — the west coast of Denmark at 57°00 ' N. nets whose mesh size is 32 millimetres or less in Regions 1 and 2 or 40 millimetres or less in Region 3 in accordance with Article 2 ( 1 ) of Regulation ( EEC) 2 . Fishing for sprat shall be prohibited : — a point on the coast of the Netherlands at longitude 4°00 ' E. ( a ) from 1 July to 31 October 1987 within the area bounded by the following coordinates: 2 . By derogation from paragraph 1 it shall be permitted to — the west coast of Denmark at 55° 30 ' N , use any trawl , Danish seine or similar towed net in the areas described in paragraph 1 provided that the mesh size — latitude 55°30' N , longitude 7°00' E , is equal to or greater than 100 millimetres . — latitude 57°00 ' N, longitude 7°00' E , — the west coast of Denmark at 57°00 ' N ; 3 .
