2 In particular the Commission thus takes no account of point (a) of my statement of the problem in Section 1.2 of this Opinion, although it is in fact also covered by Question 1.1 asked by the national court. The Commission considers that that wider question can be answered only on the merits of each individual case. In its written observations, however, it concedes that there may also be some doubt in other cases as to whether material is in fact intended to form part of a particular scientific apparatus (which will have to be resolved in each individual case).
