ÖVERGÅNGSBESTÄMMELSER

Denna författning träder i kraft den 15 oktober 2013. Bestämmelserna ska tillämpas från och med den 1 augusti 2012.

TÜRKİYE CUMHURİYETİ İLE İSVEÇ KRALLIĞI ARAS- INDA 30.06.1978 TARİHİNDE İMZALANAN SOSYAL GÜVENLİK SÖZLEŞMESİNİ DEĞİŞTİREN EK SÖZLEŞMENİN UYGULANMASINA İLİŞKİN EK İDARİ ANLAŞMA

Türkiye Cumhuriyeti ile İsveç Krallığı Arasındaki Sosyal Güvenlik Sözleşmesini Değiştiren Ek Sözleşmenin Uygulanmasına ilişkin olarak iki Tarafın Yetkili Makamları aşağıdaki hususlarda mutabık kalmışlardır.

BÖLÜM I ÖZEL HÜKÜMLER

Yaşlılık, Malullük ve Ölüm (Geride Kalanlar)

Madde 1

20 inci madde hükümlerine bakılmaksızın, akit taraf mevzuatına göre geçen sigortalılık sürelerinin toplam uzunluğu bir yılı bulmuyorsa ve yalnız bu süreler dikkate alındığında bu mevzuata göre hiçbir hak doğmuyorsa, yetkili akit taraf Sigorta Kurumu anılan sürelere istinaden yardım sağlamaz.

Türk mevzuatına göre prim veya kesenek ödenmiş bir yıl 360 gün olarak kabul edilir.

Yürürlük

Bu Ek İdari Anlaşma Sözleşmeyi Değiştiren Ek Sözleşme ile birlikte yürürlüğe girer.

SUPPLEMENTARY ADMINISTRATIVE AGREEMENT FOR THE APPLICATION OF THE SUPPLEMENTARY CONVEN- TION AMENDING THE SOCIAL SECURITY CONVENTION BETWEEN THE REPUBLIC OF TURKEY AND THE KING- DOM OF SWEDEN SIGNED ON 30.06.1978

Both parties have agreed upon the following provisions for the application of the Supplementary Convention amending the Social Security Convention between the Republic of Turkey and the Kingdom of Sweden.

SECTION 1 Special Provisions

Old Age, Invalidity and Death (Survivors)

Article 1

Notwithstanding the provisions of Article 20, where the total duration of the periods of insurance completed under the legislation of a Contracting Party is less than one year and where on the basis of those periods only, no right to benefit exists under that legislation, the institution of the Party concerned shall not be bound to grant benefit in respect of said periods.

In determining the periods of contribution under Turkish legislation one year shall be considered as equivalent to 360 days.

Article 2

Entry into Force

This Supplementary Administrative Agreement enters into force concurrently with the Supplementary Convention amending the Convention.
